Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
February 5,
2007 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Pickett, Councilman Miller, Town Clerk Erlandson, Attorney Wright, Legislator Spicer.
Absent: Councilman Geisler, Councilman Heintzelman, Highway Superintendent Shellhouse.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
The Town Council observed a moment of silence
in memory of Councilman Robert Heintzelman’s father who recently passed away.
Motion
by Councilman Miller, seconded by Councilman Pickett to accept the minutes of
the January 15, 2007 meeting as presented by the Town Clerk.
Town Clerk Erlandson read the
following items into the record:
1.
Notification
re the annual Southern Tier West Local Government Conference to be held
at Houghton College on May 9, 2007.
2.
Notification
of liquor license renewal: Falconer Moose, 11 S. Dow St., Falconer.
3.
Notification
of liquor license renewal: Moonbrook Country Club, 2879 Rte. 60.
4.
Invitation
to a Legislative Breakfast sponsored by the Chautauqua County of Commerce to
be held at the Lakewood Rod & Gun Club on March 9, 2007.
5.
Newsletter:
Chautauqua Co. Chamber of Commerce.
6.
Newsletter:
So. Tier West Regional Planning & Development Board.
TOWN OFFICERS’ REPORTS
Town Clerk Erlandson reported that Ellicott
Assessor Marsha Painter would be meeting with several veterans associations in
the Town to outline the various property tax exemptions available to veterans.
Sign at
Airport Industrial Park – Town
officials will continue to meet with Chautauqua Co. officials to determine how
to repair the sign at the Airport Industrial Park. (Minutes 1/15/07) Legislator Spicer stated that he would assist the Town if
necessary. Tabled pending further
review.
Water Pump Station in School
Ave. Area –
An Informational Meeting was conducted on Jan. 24, 2007 at 7:00 at Southwestern
Central School re the proposed installation of a new water pump station
in the School Ave. area of West Ellicott.
(Minutes 11/6/06 et. seq.) The
Town Council scheduled a Public Hearing for March 5, 2007 at 7:00 PM to
determine whether to move forward with the installation of the pump station.
NEW BUSINESS
The Regular Town Council
meeting scheduled for Feb. 19, 2007 was cancelled in observance of President’s
Day.
RESOLUTION # 39-07
Accept
Resignation of Town Employee (Grazulewicz)
Motion by Supervisor Tyler, seconded by Councilman
Miller to accept the resignation of Bridget Grazulewicz, former Assessing
Clerk, effective January 16, 2007.
Adopted. Ayes - 3 Noes - 0 Absent - 2
Request for Municipal Water Service –
Town Clerk Erlandson presented a petition
signed by seven (7) residents of Buffalo St. Ext. (between Willard St. Ext.
& Peck-Settlement Rd.) requesting that the Town of Ellicott extend
municipal water service
to their homes. Highway Superintendent
Shellhouse will obtain preliminary cost
estimates for the project.
Rezoning Request (Fairmount
Plaza) – The Town Council
discussed a new, revised request to rezone property adjacent to the Fairmount Ave. Plaza. Island Capital LLC, a real estate development
company from Troy Michigan, submitted the request. The developers are requesting that the property be rezoned
‘mercantile’ in anticipation of replacing the plaza with a new retail
center. The Council discussed the
request & examined an engineering map of the proposed project. Supervisor Tyler reminded the Council that
the company submitted an initial request to rezone the property on Oct. 6,
2006. (Minutes 10/2/06 et. seq.) That request was denied. According to Mr. Tyler the new request has
been significantly scaled back to include less of the surrounding
property. He noted that the total area
the developer is requesting be rezoned is less than 5 acres. He also pointed out that the proposed new
retail building will be located completely within the existing zoning boundaries. Tabled until the March 5, 2007 Town Council
meeting.
RESOLUTION #40-07
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Pickett to pay 2007
current claims #54-137, inclusive, in the amount of $56,054.96 and charge
to the proper fund or account.
Adopted. Ayes - 3 Noes - 0 Absent - 2
