Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

February 18, 2003 at 12:00 P.M.

 

Present: Supervisor Tyler, Councilman Lodestro, Councilman Miller, Councilman Taylor, Town Clerk Erlandson, Highway Superintendent Shellhouse.  Absent: Councilman Geisler.

 

Supervisor Tyler opened the meeting at 12:10 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called the roll. 

 

APPROVAL OF MINUTES

 

Motion by Councilman Lodestro, seconded by Councilman Taylor to accept the minutes of the February 3, 2003 meeting as presented by the Town Clerk.

PRIVILEGE OF THE FLOOR

 

Mr. Edward Martiny, Lakewood, NY, discussed several potential zoning discrepancies pertaining to a section of N. Main St. Ext. (Rte. 60).  He also pointed out problems with the existing sewer line along N. Main St. Ext.  According to Mr. Martiny, the sewer line was not designed to facilitate future development.  In his opinion, the line needs to be upgraded.  He asked the Town Council to address the problems.

 

CORRESPONDENCE

 

            Town Clerk Erlandson read the following items into the record:

 

1.      Notification of liquor license renewal: Comfort Inn, 2800 N. Main St. Ext.

2.      Notification re the Annual So. Tier West Local Gov’t. Conference to be held in May 2003.

3.      Letter from Sue Seamons, Director, Falconer Public Library thanking the Ellicott Town Council for its annual donation to the library.

 

TOWN OFFICERS’ REPORTS

 

Highway Superintendent Shellhouse reported that the New York State Consolidated Highway Improvement Funding (CHIPs) program should continue in 2003.

 

OLD BUSINESS

 

Permit for Herbicide Application (Chautauqua Lake) – The Town Council discussed the permit process re herbicide application on certain areas of Chautauqua Lake.  Town Clerk Erlandson will contact the New York State Dept. of Environmental Conservation to determine how to proceed.

 

Traffic Safety Concerns: Fairmount Ave. Supervisor Tyler & Highway Superintendent Shellhouse will attend the next Chautauqua Co. Traffic Safety Committee meeting to discuss concerns re traffic safety on Fairmount Ave.

 

Water Service on Camp St. Ext. – Tabled until the March 3, 2003 meeting.

 

Water Service on Orchard Rd. – A representative from Tolman Engineering presented a preliminary map plan & report for extending water service to Orchard Rd.  The plan involves connecting to an existing water line on Howard Ave.  The Council reviewed the proposal & discussed alternative methods of charging the residents.  Supervisor Tyler suggested that Attorney Gregory Yaw be contacted for advice on how to proceed.    

 

NEW BUSINESS

 

RESOLUTION #49-03

New Truck for Ellicott Highway Dept.

 

Motion by Councilman Lodestro, seconded by Councilman Miller authorizing the Ellicott Highway Superintendent to purchase a new 2003 International Heavy Duty Single-axle Dump Truck for the Ellicott Highway Department at the New York State Contract price of $72,028.65.

RESOLUTION #50-03

Advertise for Bids

 

Motion by Councilman Lodestro, seconded by Councilman Miller authorizing the Ellicott Highway Superintendent to advertise for bids for a dump/sander box and plow equipment.

Police Chief Position – Councilman Lodestro reported that he & Councilman Taylor recently met to discuss the vacant Ellicott Police Chief position.  He noted that Ellicott Police Sergeant William Ohnmeiss has been serving as acting police chief since former Chief Vanstrom passed away on Jan. 20, 2003.  Mr. Lodestro recommended that Sergeant Ohnmeiss be appointed provisional police chief pending his performance on a mandatory civil service test.

 

RESOLUTION #51-03

Appoint Provisional Police Chief (Ohnmeiss)

 

Motion by Councilman Lodestro, seconded by Councilman Taylor appointing Town of Ellicott Police Sergeant William Ohnmeiss as provisional Town of Ellicott Police Chief contingent upon his performance on a mandatory civil service exam to be conducted on a future date and; furthermore, establishing a three-year eligibility requirement for the position of Town of Ellicott Police Sergeant.

RESOLUTION #52-03

Budget Transfers & Encumbrances


Motion by Supervisor Tyler, seconded by Councilman Taylor authorizing Town of Ellicott Supervisor to make the following 2002 budget transfers & encumbrances:

 

Transfer the amount of $10,465.00 from Account #A6889.4 (Economic Development) to Account #A9730.6 (BAN Principal: Upgrading of Ellicott Administration Building); encumber the amount $19,296.50 to Account #B3620.2 (Safety Inspection – Equipment); encumber the amount of $14,851.55 to Account #A3120.9 (DWI); encumber the amount of $38,000.00 to Account #A6460.4 (IDA).

RESOLUTION #53-03

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Miller to pay 2003 current claims #112-172, inclusive, in the amount of $72,866.92 and charge to the proper fund or account.

RESOLUTION #54-03

Convene Executive Session (re Labor Agreement)

 

Motion by Supervisor Tyler, seconded by Councilman Taylor to Convene Executive Session for the purpose of discussing negotiations regarding the renewal of a Labor Agreement between the Town of Ellicott and Town of Ellicott CSEA employees.        12:55 – 1:10 PM
