Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
March 3, 2003
at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Lodestro, Councilman Miller, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker.
Absent: Councilman Taylor.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Lodestro, seconded by Councilman Miller to accept the minutes of
the February 18, 2003 meeting as presented by the Town Clerk.
Mr. Robert Woodard, 257 E. Elmwood Ave.,
Falconer, NY, commented on a proposal by the Ellicott Town Council to apply for
an aquatic herbicide permit from the New York State dept. of Environmental
Conservation. The herbicide would be
applied to certain areas of Chautauqua Lake to control Eurasian milfoil. In his opinion, applying chemical herbicides
is harmful to the lake. Mr. Woodard
recommended that the Council to address several issues before applying for the
permit. Mr. David Leitch, 3126
N. Main St. Ext., asked whether the Ellicott Town Council has allocated monies
for the proposed herbicide application.
Supervisor Tyler outlined the various funding allocations.
Mr. Ben Haskins, Peck-Settlement Rd.,
commented on the legalization of marijuana.
Town Clerk Erlandson read the
following items into the record:

Notification
of an upcoming Regional Leadership Academy sponsored by So. Tier West Regional
Planning Board.
2.
Newsletter:
Chautauqua Watershed Conservancy.
3.
Falconer
Fire Dept. Incident Report: December 2002.
TOWN OFFICERS’ REPORTS
Councilman
Lodestro reported that
he has received complaints from residents re excessive noise at two (2) Willard
St. Ext. locations. Mr. Lodestro asked the
Town Council to consider adopting a noise ordinance for the Town of
Ellicott.
Town Clerk Erlandson reported that he received a
price quote from DFT Communications to upgrade the telephone answering
system at the Ellicott Administration Bldg.
Mr. Erlandson explained that the cost of overhauling the system would not
exceed $1,120.00. He noted that
monies are available in the 2003 budget to cover the expense.
Mr. Erlandson also reported that he would be attending a Civil Service training session in Mayville, NY on March 27, 2003. The training will be conducted by the Chautauqua Co. Dept. of Human Resources.
Highway
Superintendent Shellhouse reported
on sewer problems at Lyndon Park.
Supervisor
Tyler reported that he and
Councilman Lodestro recently attended a meeting re the possibility of extending
U.S. Rte. 62 to I-86 near Falconer.
Permit for Herbicide
Application (Chautauqua Lake) – Mr. George Anderson, Chautauqua Lake Partnership, reported that the application for an aquatic herbicide
permit has been nearly completed. He
reminded the Town Council that the herbicide would be applied to certain areas
of Chautauqua Lake to control the proliferation of Eurasian
milfoil. Mr. Anderson added that he and
Town Clerk Erlandson are preparing the Environmental Assessment Form (EAF) in conjunction with the permit application as required by the N.Y.
State Dept. of Environmental Conservation.
Mr. Anderson and the Council discussed potential liability issues
concerning the herbicide application.
Traffic Safety Concerns: Fairmount Ave. – Supervisor Tyler reported that he & Highway
Superintendent Shellhouse recently attended a Chautauqua Co.
Traffic Safety Committee meeting.
During the meeting, they discussed concerns re traffic safety on
Fairmount Ave. at the entrance to Sam’s Club. According to Mr. Tyler, the N.Y. State Dept.
of Transportation will review the matter and make a recommendation re how to
improve traffic safety at that location.
Water Service on Camp St. Ext. – Tabled until the March 17, 2003 meeting.
Water Service on Orchard Rd. – Tabled until the March 17, 2003 meeting.
NEW BUSINESS
Motion by Councilman Lodestro, seconded by Councilman Miller authorizing the
Town of Ellicott Supervisor to sign an agreement between the Town of
Ellicott and the Chautauqua Lake Association stipulating that the Town pay
the CLA the amount of $2,500.00 (two thousand five hundred dollars) for a lake
maintenance program conducted in 2003.

RESOLUTION #56-03
Adopt Local Law #1-03
(Establish Date for Grievance Day)
Motion by Supervisor Tyler, seconded by Councilman Miller stipulating that the
Ellicott Board of Assessment Review shall meet on the next
Tuesday after the fourth Tuesday in May of each year and thereafter as
may be necessary to discharge its duties relative to Grievance Day.

Police Chief Salary –
The Council discussed setting a salary
for recently appointed Ellicott Police Chief William
Ohnmeiss (Minutes 2/18/03). The Council directed Town Clerk Erlandson to contact area
police departments & compile the salaries of other chiefs.
RESOLUTION #57-03
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Miller to pay 2003 current claims #182-235,
inclusive, in the amount of $15,617.07 and charge to the proper fund or
account.

RESOLUTION #58-03
Convene Executive Session (re Pending Litigation & Labor Agreement)
Motion
by Supervisor Tyler, seconded by Councilman Miller to Convene Executive Session for the purpose of discussing
negotiations regarding pending litigation and the renewal of a Labor
Agreement between the Town of Ellicott and Town of Ellicott CSEA
employees 7:43 – 8:36 PM
