Minutes of a Regular Meeting of the

Town Council of the Town of= Ellicott

held at = the Administration Building,

215 S. Work Street, Falconer, N.Y. on

March 15= , 2010 at 7:00 P.M.

 

Present: Supervisor Miller, Councilman Orlando, Councilman Beckerink, Councilman Lodestro, Councilman Heintzelman, Town Cle= rk Erlandson, Highway Superintendent Shellhouse, Attorney Wright, Legislator Barmore, Code Enforcement Officer Woodbury, Planning Board Chairman Evans.<= /p>

 

Supervisor Miller open= ed the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called t= he roll.

PUBLIC HEARING (Town of = Ellicott Comprehensive Plan)

 

Supervisor Miller opened a Public Hearing regarding environmental review for a proposed Comprehensive Plan for th= e Town of Ellicott.&nbs= p; The following public comments were heard:

 

Karen= Rine, 87 Longview Ave. expressed concern about the condition of Burtis Bay & Burtis Bay Park.&nbs= p; In her opinion, the new Comprehensive Plan should address the matter.  Mrs. Rine also expres= sed her desire that the plan include provisions for protecting the entire Chautauqua Lake watershed.

 

Jay F= ickling, 66 N. Allegheny Ave. asked that his neighborhood maintain its ‘residential’ zoning designation.  He is opposed to= the area being zoned ‘commercial’.

 

Richa= rd Benedetto, 41 Dunham A= ve. pointed out that a section of property along the west side of Dunham Ave.= would be classified ‘low intensity commercial’ under the proposed plan.  He recommended that this classification be extended all the way to the east side of N. Allegheny Ave. which is designat= ed ‘residential’ under the proposed plan.

 

Sheila Webster, 45 Elmwood Av= e. commended the Town Council and other Town officials for their hard work in developing the proposed comprehensive plan.  She pointed out that the last comp= rehensive plan for the Town was adopted nearly 30 years ago.  In her opinion, the new comprehens= ive plan is a good one.

 

David= Leitch, 3126 N. Main St. Ext. asked if there are any specific plans for modifying the zoning along t= he Rte. 60 corridor north of the City of Jamestown – aside from what’s been outlined in the proposed comprehensive plan.  Councilman Heintzelman explained that the zoning indicated in t= he proposed plan is just a guideline.  He stated that any actual rezoning would not occur without input from residents of the area.

 

Motion by Supervisor Miller, seconded by Councilman Heintzelman to close the Public Hearing at 7:21 = PM.

MOTION by Councilman Heintzelman, seconded by Councilman Lodestro to accept the minutes of the March 1, 2010 meeting as presented by the Town Clerk.

PRIVILEGE OF THE FLOOR

 

Gene= Aversa, 6 Topo Lane asked the Town Council if there has been = any discussion concerning the feasibility of “dissolving” the villa= ges of Celoron & Falconer.  Su= pervisor Miller explained that the Ellicott Town Council has no authority regarding = the matter.  Attorney Wright noted= that dissolving a village would require a public referendum by village residents= .  He added that any consideration to “dissolve” a village would have to be initiated by the village Board of Trustees.

TOWN OFFICERS’ REPORTS

 

Counc= ilman Orlando reported that the Ellicott Facilities Committee is continuing to look into the feasibility of applying for an energy efficiency grant.

RESOLUTION #41-10

Declaration of Intent = (re Lead Agency for Environmental Review of Comprehensive Plan)

 

MOTION by Councilman Heintzelman, seconded by Councilman Beckerink = declaring the Town of Ellicott’s intention= to be lead agency for environmental review of the proposed Comprehensive Plan of = the Town of Ellicott, the Village of Celoron and the Village of Falconer in accordance with the New York State Environmental Quality Review Act (SEQR); and, further, authorizing the Town= of Ellicott Supervisor to send letters to involved agencies notifying them of = the Town’s intention to be lead agency.

Re= vise 2010 Salaries for Valerie Pierce & Larry Trask – Supervisor Miller reported that Deputy Town Clerk & part-time Bookkeeper Valerie Pierce will be retiring, effective March 31, 2010.  Mr. Miller st= ated that Mrs. Pierce would like to keep working for the Town on a part-time bas= is, beginning April 1, 2010.  Mr. = Miller stated that Mrs. Pierce has asked for a salary of $500.00 per pay period.  If the Town Council accepts her of= fer, Mrs. Pierce’s total 2010 salary (including vacation days & earnin= gs to-date) would be $25,821.41.  Supervisor Miller noted that the 2010 allocated salary for Mrs. Pierce was $46,726.00.  (Minutes 1/1/10)   He pointed out that this wou= ld be a savings of $20,904.59.  Mr. = Miller recommended that the Town Council retain Mrs. Pierce’s services.  Mr. Miller also reported that part= -time Town of Ellicott Bookkeeper La= rry Trask has offered to increase the number of hours = he works for the Town to compensate for the fewer hours that Mrs. Pierce will = be working.  Mr. Miller stated th= at Mr. Trask has requested a salary of $1,000.00 per month (i.e. $12,000.00 per year).  Mr. Miller explained t= hat this would be an increase of $7,000.00 over his current annual salary of $5,000.00.  (Minutes 1/1/10)  However, his actual salary in 2010 would be $10,250.01 since the pay increase would = not be effective until 4/1/10.  Therefore, the increase would be $5,250.01 in 2010.  Supervisor Miller recommended that= the Town Council accept Mr. Trask’s offer.  He noted that the net savings for = the Town in 2010 by retaining Mrs. Pierce on a part-time basis and increasing M= r. Trask’s salary would be $15,654.58.

 

RESOLUTION #46-10

Re-appoint Valerie Pie= rce

 

MOTION by Supervisor Miller, seconded by Councilman Orlando re-appointing = Valerie Pierce as part-time Deputy Town Clerk & part-time Bookkeeper at a salary of $25,821.00 for 2010.
