Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
March 19, 2007
at 7:00 P.M.
Present: Supervisor Tyler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Wright.
Absent: Councilman Geisler.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Heintzelman, seconded by Councilman Miller to accept the minutes
of the March 5, 2007 meeting as presented by the Town Clerk.
Town Clerk Erlandson read the
following items into the record:
1.
Minutes
of the March 7, 2007 meeting of the Falconer Fire Advisory Board.
2.
Notification
re the annual Local Government Conference sponsored by Southern Tier West to
be held at Houghton College on May 9, 2007.
3.
Notice
of an upcoming seminar re “Hiring a Consultant” to be conducted by So. Tier
West Regional Planning & Development Board on March 29, 2007.
4.
Designation
of Restricted Highways: County Rd. 605 (Ross Mills Rd.) & CR 340 (Water
Street).
5.
Notice
re an upcoming free rabies vaccination clinic to be held in Dunkirk, NY.
Councilman Miller reported that he attended a
recent meeting of the Falconer Fire Advisory Board. He stated that the Falconer Fire
Dept. has requested an additional $2,750.00 from the Town of Ellicott in
2008. He explained that the department
wants to upgrade its equipment.
Councilman Heintzelman reported on a drainage
problem on Gaylord Ave. He asked
Highway Superintendent Shellhouse to look into the matter.
Mr. Heintzelman also reported that the
Ellicott Zoning Commission will meet on March 29, 2007. He stated that the commission would be
discussing a request to rezone 13.1 acres of property east of N. Main St. Ext.
(Minutes 3/5/07).
Mr. Heintzelman also distributed a proposal
to create four-year terms for the Town Council, Town Supervisor and Town
Clerk. He asked the Council to review
the proposal.
Highway Superintendent
Shellhouse reported
on an odor problem with a sewer pump station on N. Main St. Ext. He stated that he has asked the Jamestown Board
of Public Utilities to address the problem.
Mr. Shellhouse also reported that the
Jamestown BPU is looking into a cheaper, alternative solution to
alleviating the water-pressure problem in the School Ave. - Howard Ave.
area. He explained that constructing a
pump station might not be necessary.

Request for Municipal Water Service (Buffalo
St. Ext.) – Highway Superintendent Shellhouse distributed a tentative cost estimate for extending municipal water service to
Buffalo St. Ext. between Willard St. Ext. and the Peck-Settlement Rd. (Minutes 3/5/07) The Council scheduled an Informational
Meeting for April 2, 2007 at 6:30 PM to outline the proposed
project to the residents.
Request for Rezoning (N. Main St. Ext.) –
The Council discussed a request to rezone a
section of property on North Main St. Ext. (Rte. 60) to ‘mercantile’. (Minutes 3/5/07)
Motion by Supervisor
Tyler, seconded by Councilman Miller to refer a request to rezone 13.8 acres of property located east of North Main Street
Ext. (Rte. 60) to
the Ellicott Planning Board for further review.
Carried.

NEW BUSINESS
“In-kind” Partnership
Agreement: Chautauqua County Soil & Water Conservation District
Motion by Supervisor Tyler,
seconded by Councilman Pickett authorizing the Town of Ellicott Highway
Department to provide approximately fifty (50) hours of “in-kind” labor
and equipment to the Chautauqua County Soil & Water Conservation
District for certain projects involving road maintenance and construction. (See ‘Chautauqua Co. Soil & Water
Conservation District’ file for detail)

Chautauqua Lake Local Waterfront Revitalization
Program – Supervisor Tyler reported that the Town of
Ellicott has received notice that the State of New York Dept. of State
has initiated the 60-day review
of the Chautauqua Lake Inter-Municipal Draft Local Waterfront Revitalization
Program (LWRP). Mr. Tyler stated
that public comments must be received
no later than May 14, 2007. (See ‘LWRP’
