Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
March 21, 2005
at 7:00 P.M.
Present: Supervisor Tyler, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Legislator Spicer.
Absent: Councilman Geisler, Councilman Pickett.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Heintzelman, seconded by Councilman Miller to accept the minutes
of the March 7, 2005 meeting as presented by the Town Clerk.
Mr. Chris Lindstrom representing Tanglewood
Manor, 560 Fairmount Ave., expressed his concerns about pedestrian safety
on Fairmount Ave. (Rte. 394). He
reminded the Council that over the past weekend a Tanglewood resident
was struck by a car and killed while crossing Fairmount Ave. in front of their
facility. Mr. Lindstrom asked the Town
Council to address the traffic safety situation on Fairmount Ave. in the Tanglewood
Manor vicinity.
Supervisor Tyler responded to Mr.
Lindstrom. He explained that Fairmount
Ave. is a New York State highway and pointed out that in 2002, the Ellicott
Town Council asked the NYS Dept. of Transportation to look into the feasibility
of installing a traffic light on Fairmount Ave. in the vicinity of Tanglewood. According to Mr. Tyler, at that time the DOT
determined that a traffic light was not necessary.
Mrs. Barbara Suter, representing Tanglewood
Manor, also commented on the matter.
She presented a petition to the Council requesting that a traffic light
be installed on Fairmount Ave. near Tanglewood Manor.
Mrs. Lisa Ross, Celoron, also asked the
Council to address the traffic safety situation on Fairmount Ave. in front of Tanglewood
Manor.
Town Clerk Erlandson read the
following items into the record:

re the Annual Falconer Firemen’s Appreciation Dinner to be held on Apr.
4, 2005.

Letter from Falconer Public Library thanking the Ellicott Town
Council for its annual contribution to the library.

Letter
from Falconer American Legion thanking the Ellicott Town Council for its
annual contribution to the legion.
4.
Notification
re the annual Southern Tier West Local Government Conference to be held
at Houghton College on May 12, 2005.
5.
Notification
re an upcoming Leadership Academy to be sponsored by So. Tier West
Regional Planning & Development Board.
6.
Notice
from the Chautauqua County Health Dept. re two upcoming Free Rabies
Vaccination Clinics.
7.
Newsletter:
Chautauqua County Chamber of Commerce.
TOWN OFFICERS’ REPORTS
Councilman Heintzelman reported that he recently became aware of several abandoned cars on properties in his ward. He expressed his concern that the Town of Ellicott Code Enforcement Officer has limited enforcement powers in regards to having abandoned vehicles removed. He asked Attorney Lasker to look into the matter.
Mr. Heintzelman also reported that he is working with Councilman Geisler and Town Clerk Erlandson to compile an employee handbook for Town of Ellicott management and non-union employees.
Town Clerk Erlandson stated that he received a petition signed by 165 residents requesting the Ellicott Town Council to install a traffic signal on Fairmount Ave. in the vicinity of Tanglewood Manor. (see ‘Privilege of the Floor’)
Mr. Erlandson also reported that he
received several letters from Tanglewood Manor officials asking the Town
Council to address traffic safety concerns on Fairmount Ave.
Relocation of DEC Offices/DEC Lease – Councilman Miller reported
that the N.Y. State Office
of General Services has refused the Town of Ellicott’s recent
offer regarding the rental of floor space
in the Ellicott Administration Bldg. by the NYS Dept. of Environmental Conservation. He
reminded the Council that the Town’s offer was $15.00 per sq. ft. However, OGS wants to pay no more
than $11.00 per sq. ft. (Minutes
3/7/05) The Council discussed the
matter and decided to hold firm at $15.00 per sq. ft. Tabled pending further negotiations.
Expansion of Water Service
(Howard Ave./Baker St. Ext./Valerie Lane) – An Informational Meeting has been
scheduled for April 6, 2005 at 6:30 PM at the Community Center in Celoron for
residents of Howard Ave., Baker St. Ext. & Valerie Lane. At the meeting, Town officials will outline
a feasibility study concerning the possibility of expanding municipal water
service to those areas.
NEW BUSINESS
RESOLUTION #48-05
Purchase of New Truck for
Highway Dept.
Motion by Supervisor Tyler, seconded by Councilman Heintzelman authorizing the
Ellicott Highway Superintendent to purchase a new pickup truck for the
amount of $20,992.00; purchase shall include a trade-in value of $10,600.00 for
an existing pick-up truck.

RESOLUTION #49-05
Budget Transfers and Appropriations
Motion by Supervisor Tyler,
seconded by Councilman Miller authorizing Town of Ellicott Supervisor to make
the following budget appropriation:
Appropriate the amount of $43,803.23
(Unanticipated Revenues) to Account
#DB5112.2 (Capital Outlay).

RESOLUTION #50-05
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Heintzelman to pay 2005
current claims #266-311, inclusive, in the amount of $42,594.42 and charge
to the proper fund or account.
