Minutes of a Regular Meeting of the

Town Council of the Town of= Ellicott

held at = the Administration Building,

215 S. Work Street, Falconer, N.Y. on

April 19= , 2010 at 7:00 P.M.

 

Present: Supervisor Miller, Councilman Orlando= , Councilman Beckerink, Councilman Lodestro, Councilman Heintzelman, Town Clerk Erlandso= n, Legislator Barmore.  Absent: Highway Superintendent Shellhouse.

 

Supervisor Miller open= ed the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called t= he roll.

APPROVAL OF MINUTES

 

MOTION by Councilman Heintzelman, seconded by Councilman Lodestro to accept the minutes of the April 5, 2010 meeting as presented by the Town Clerk.

CORRESPONDENCE

 

        &= nbsp;   Town Clerk Erlandson read the following items into the record:=

 

1.      Notification re the an= nual Local Government Conference sponsored by So. Tier West Regional Planning & Devel.  Board to be = held at Houghton College on May = 5, 2010.

2.      Notification re the an= nual Village<= /st1:PlaceType> of Falconer Memorial Day Parade to be held on May 31, 2010.

3.      Notification re a meet= ing of the Chautauqua County Conference of Mayors & Supervisors to be held on April 29, 2010.

4.      Notice from Chautauqua Co. Health Dept. re the results of a free rabies vaccination clinic that was recently held in Dunkirk.

5.      Newsletter: Chautauqua Co. Office of Emergency Services.

6.      Falconer Fire Chief’s Report: March 2010.<= /span>

TOWN OFFICERS’ REPORTS

 

Coun= cilman Lodestro reported that he is lo= oking into several invoices the Town of Ellicott has received from the Jamestown Boa= rd of Public Utilities pertaining to the Buffalo-Willard Water District.  He is not certain that the Town sh= ould have received the invoices.

 

Coun= cilman Orlando reported that the Ellic= ott Facilities Committee recently received an estimate from Ahlstrom-Schaeffer Electric Corp. for upgrading the lighting at= the Ellicott Administration Bldg. & the Ellicott Highway Garage.  He explained that the cost of the upgrade would be approximately $30,000.00.=   He noted even though the town would receive approximately $7,000.00 = in “rebates” from the Jame= stown BPU for upgrading the lighting, the committee feels that the project is= too costly to pursue at the present time.  Mr. Orlando also reported that the Facilities Committee received an estimate to remove the chimney on the roof of the Ellicott Administration B= ldg.

 

Supe= rvisor Miller updated the Town Council= re the status of the New York State O= ffice of the Attorney General’s request concerning salary and overtime information for Town of Ellico= tt retired employees.  (Minutes 4/5/10)  He stated that Town C= lerk Erlandson compiled the information and has mailed it to the Attorney General’s office.

 

Mr. = Miller also reported that the Jam= estown Planning Commission is looking = into the possible abandonment of a section of Magnolia Ave. between Huxley Ave. and the Town of Ellicott line.  The commission will discuss the ma= tter at its next meeting on April 20, 2010.

 

Mr. = Miller also reminded the Town Council that the Town of Ellicott CSEA Highway & Police Units have filed grievances against the = Town of Ellicott.  He explained that Step 4 of the grievance procedure involves presenting the grievance to the Town Council.<= span style=3D'mso-spacerun:yes'>  He noted that the grievances will = be heard at an upcoming own Council meeting.  He stated that CSEA representatives have asked that the grievances be heard in Executive Session.  M= r. Miller feels that the grievances should be heard in open session.  The Council concurred.<= /span>

Adopt Town of Ellicott Comprehensive Plan

 

MOTION by Councilman Heintzelman, seconded by Councilman Orlando to adopt a new Town of Ellicott Comprehensive Plan.

Close Negotiations w/ = CSEA Police Unit

 

MOTION by Supervisor Miller, seconded by Councilman Lodestro to close negotiations with the Town of = Ellicott CSEA Police Unit regarding a new labor agreement u= ntil further notice.

Payment of Claims=

 

MOTION by Supervisor Miller, seconded by Councilman Beckerink to pay Abstract #8 in the amount of $121,977.63 and charge to the proper funds or accounts.
