Minutes of a Regular Meeting of the =

Town Council of the Town of= Ellicott

held at = the Administration Building,

215 S. Work Street, Falconer, N.Y. on

April 20= , 2009 at 7:00 P.M.

 

Present: Supervisor Miller, Councilman Orlando= , Councilman Beckerink, Councilman Lodestro, Councilman Heintzelman, Town Clerk Erlandso= n, Highway Superintendent Shellhouse, Attorney Wright, Legislator Barmore.

 

Supervisor Miller open= ed the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called t= he roll. 

 

APPROVAL OF MINUTES

 

MOTION by Councilman Heintzelman, seconded by Councilm= an Lodestro to accept the minutes of the April 6, 2009 meeting as presented by= the Town Clerk.

TOWN OFFICERS’ REPORTS

 

Counc= ilman Lodestro reported that the Ellicott Facilities Committee met on April 8, 2009.  He outlined several pro= jects that the committee hopes to complete in 2009.  First, he stated that the committe= e has obtained cost estimates for replacing the roof at the Ellicott Administrati= on Bldg.  The committee is also l= ooking into replacing the carpet in the Town offices as well as re-surfacing the parking lot outside the Administration Bldg.  Mr. Lodestro stated that the commi= ttee would be meeting again on April 22, 2009.

 

Counc= ilman Orlando reported that he recently met with the new Mayor of Celoron re = the possibility of sharing services.

 

Mr. O= rlando also reported that he has received the= flags for veterans’ gravesites in the cemeteries located within the Town of= Ellicott.  (Minutes 10/6/08 et. seq.)

 

Town Clerk Erlandson reported that Villa= ge of Celoron official= s are interested in conducting a dog census in the village.  He will obtain more details in the= next few weeks.

 

Mr. Erlandson also reported that the 2009 property tax collection period has ended.  He stated that all unp= aid taxes have been returned to the Chautauqua Co. Office of Real Property Tax Services.

 

Super= visor Miller reported that 2008 Annual Financial Report for the Town of Ellicott should be completed this week.

Gift Policy= – Supervisor Mi= ller stated his desire for the Town of Ell= icott to implement a policy for accepting gifts from vendors.  Attorney Wright commented on the matter.  He explained that Sec= tion 805a of the NYS General Municipal Law stipulates that municipal employees m= ay not accept gifts in excess of $75.00.  However, he noted that the Town Council may establish a lower limit.  He also suggested that= the gift policy be a part of an overall “ethics policy”.  Mr. Wright will continue to look i= nto the matter.  Tabled pending fu= rther review. 

 

Reduction of Speed Lim= it (Baker Street Ext.) – Highway Superintendent Shellhouse reported that the Chauta= uqua Co. Dept. of Public Facilities = has requested a reduction in t= he speed limit on a section of Baker Street Ext. located in the Town of Ellicott west of = Howard Ave.=

RESOLUTION #47-09

Reduction of Speed Limit (Baker St. Ext.)=

 

Motion by Supervisor Miller, seconded by Councilman Heintzelman requesting= the New York State Department of Transportation to reduce the spe= ed limit to 45 MPH on a section of Baker Street Ext. located in the Town of Ellicott west of = Howard Ave.=

Accept Bids for Highway Materials & Services

 

Motion by Supervisor Miller, seconded by Councilman Beckerink authorizing Highway Superintendent Shellho= use to accept the Chautauq= ua County bids for highway materials and services.

 

RESOLUTION #49-09

Payment of Claims=

&nb= sp;

MOTION by Supervisor Miller, seconded by Councilman Heintzelman to pay Abstract #7 in the amount of $131,920.85 and charge to the proper funds or accounts.
