Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

May 5, 2003 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Geisler, Councilman Lodestro, Councilman Miller, Councilman Taylor, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker.

 

Supervisor Tyler opened the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called the roll. 

 

APPROVAL OF MINUTES

 

Motion by Councilman Geisler, seconded by Councilman Miller to accept the minutes of the April 21, 2003 meeting as presented by the Town Clerk.

PRIVILEGE OF THE FLOOR

 

Mr. Robert Shaul, 179 Royal Oaks WE, asked the Council about the possibility of expanding municipal water service to a section of his street.  Highway Superintendent Shellhouse will look into the matter.

 

CORRESPONDENCE

 

            Town Clerk Erlandson read the following items into the record:

 

1.      Notice re the annual So. Tier West Local Government Conference.

2.      Invitation from the Falconer American Legion re upcoming Memorial Day Services.

3.      Notice of restricted highway: S. Dow Street, Falconer.

4.      Notice from the Chautauqua County Health Dept. re the Spring 2003 free animal rabies vaccination schedule.

 

OLD BUSINESS

 

RESOLUTION #79-03

Ratify CSEA Contract

 

Motion by Councilman Miller, seconded by Councilman Taylor to adopt a Labor Agreement between the Town of Ellicott and CSEA Local 1000, General Unit 6314 of Local 807 certified union for the Town of Ellicott Highway and Office employees, retroactive to January 1, 2003; agreement to expire on December 31, 2004.

Permit for Herbicide Application (Chautauqua Lake) – Tabled pending response from the New York State Dept. of Environmental Conservation.

 

Lyndon Blvd. Reconstruction Project - Councilman Lodestro reported on the status of repairs re several breaks in the sewer line along Lyndon Blvd. (Minutes 4/7/03) Mr. Lodestro & Highway Superintendent Shellhouse are working with Project Coordinator Rose Wightman to resolve the matter.

 

Home Rule Legislation (Chautauqua Lake Protection & Improvement District) – Supervisor Tyler reported that a Public Informational Meeting would be held on June 3, 2003 at the Celoron Community Center to discuss proposed legislation concerning the creation of a Chautauqua Lake Protection & Improvement District. 

 

Water Service on Camp St. Ext. – Highway Superintendent Shellhouse reported that installation of the new water line along Camp St. Ext. Ellicott east of Swanson Rd. has been completed.  He added that the Ellicott Highway Dept. should complete restoration operations within the next several weeks.  He asked Supervisor Tyler to begin securing funding for the project.  Mr. Tyler stated that he would secure the funding as soon as he receives the final cost figures.

 

Water Service on Orchard Rd. – Supervisor Tyler reminded the Council that an Informational Meeting re the proposed installation of a municipal water line on Orchard Rd. & Southwestern Dr. is scheduled for May 12, 2003 at 7:00 PM at the Ellicott Administration Bldg.  Town Clerk Erlandson reported that he has notified all the residents of Orchard Rd. and Southwestern Dr. about the meeting.

 

Reimbursement for Use of Town Vehicle (Tyler) – Councilman Lodestro commented on the personal use of Town of Ellicott vehicles by Supervisor Tyler in late 2002.  Mr. Lodestro reminded the Council that Supervisor Tyler had agreed to make restitution to the Town (Resolution #30-03, Minutes 2/3/03).  He pointed out that, to date, Mr. Tyler has not reimbursed the Town.  The Council discussed the matter.  Mr. Tyler

Motion by Councilman Miller, seconded by Councilman Geisler to accept payment from Supervisor Tyler in the amount of $66.58 for

RESOLUTION #81-03

Accept Bids (Highway Materials & Services)

 

Motion by Supervisor Tyler, seconded by Councilman Taylor to accept (upon the recommendation of the Ellicott Highway Superintendent) the following bids for highway materials and services:

 

                        Griffith Oil – Unleaded Gasoline

                        Lictus Keystone – Diesel Fuel

                        Waterboro Gravel Products – Gravel Products

Hy-Banks/Corbett Hill - Washed Gravel & Stone

Adopt Employee Benefit Package (Okerlund)

 

Motion by Councilman Geisler, seconded by Councilman Miller to approve an employee benefit package for Town of Ellicott employee Karyn Okerlund.

RESOLUTION #83-03

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Geisler to pay 2003 current claims #480-540, inclusive, in the amount of $107,573.69 and charge to the proper fund or account.
