Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

May 18, 2009 at 7:00 P.M.

 

Present: Supervisor Miller, Councilman Orlando, Councilman Beckerink, Councilman Lodestro, Councilman Heintzelman, Town Clerk Erlandson, Attorney Wright.  Absent: Highway Superintendent Shellhouse.

 

Supervisor Miller opened the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called the roll. 

 

APPROVAL OF MINUTES

 

MOTION by Councilman Heintzelman, seconded by Councilman Lodestro to accept the minutes of the May 4, 2009 meeting as presented by the Town Clerk.

CORRESPONDENCE

 

Town Clerk Erlandson read the following items into the record:

                                   

1.      Invitation to the grand opening of the new offices of Buffamante Whipple Buttafaro, P.C.

2.      Invitation to an Annual Recognition Dinner sponsored by the Ellery Sno-Cruisers.

3.      Notice of liquor license renewal: LaScala’s 3155 Fluvanna Ave., Jamestown, NY.

4.      Notification re the annual Village of Falconer Memorial Day Parade to be held on May 25, 2009.

5.      Newsletter: Ellery Sno-Cruisers.

6.   Falconer Fire Chief’s Report: April 2009.

 

TOWN OFFICERS’ REPORTS

 

Councilman Heintzelman reported that the first draft of the new Ellicott Comprehensive Plan has been completed.  He stated that the steering committee would be meeting in the next few weeks to review the proposed plan.

 

Councilman Orlando asked about the status of the Green Ave. reconstruction project.  Councilman Lodestro commented on the matter.

 

Attorney Wright reported that the Town of Ellicott received $5,000.00 from Verizon Wireless to be used towards rectifying a drainage problem in the Idlewood Dr. area of West Ellicott near Hunt Rd.  Mr. Wright expressed concern that the payment came with a letter absolving the company of liability for any future drainage issues.  He feels that this is unacceptable.  He recommended that the Town accept the $5,000.00 but also write a letter to Verizon officials explaining that the company will not be released from future property damage claims related to drainage issues other than those related to the volume of water at the intersections of Idlewood Drive & Hunt Rd. The Town Council discussed the matter.

 

MOTION by Councilman Heintzelman, seconded by Councilman Lodestro authorizing the Town of Ellicott Supervisor to sign a letter to Verizon Wireless accepting their payment of $5,000.00 to the Town of Ellicott for the purpose of rectifying a drainage problem in the Idlewood Dr. area; and, further, that the letter stipulate that Verizon Wireless will not be released from future property damage claims related to drainage issues, other than drainage issues related to the volume of water at the intersections of Idlewood Drive & Hunt Rd.

Supervisor Miller reported that new Town of Ellicott Assessor Randall Holcomb has been meeting with property owners who do not agree with their tentative 2009 assessments.  (Minutes 5/4/09)

 

OLD BUSINESS

 

Town of Ellicott Ethics Policy – Supervisor Miller established a committee to draft a Town of Ellicott Ethics Policy.  The committee will consist of Mr. Miller, Councilman Orlando & Town Clerk Erlandson.  Tabled pending further review.

 

NEW BUSINESS

 

Authorization to Sign Letter to Flexcare Inc. – Attorney Wright reported that the bargaining unit for Town of Ellicott CSEA highway & office employees has asked the Town Council to authorize Flexcare, Inc., Niagara Falls, New York to review the current Town of Ellicott employee health insurance plan.

 

MOTION by Councilman Heintzelman, seconded by Councilman Lodestro authorizing the Ellicott Town Supervisor to sign a letter authorizing Flexcare, Inc., Niagara Falls, New York to review the current Town of Ellicott employee health insurance plan.

RESOLUTION #53-09

Payment of Claims

 

MOTION by Supervisor Miller, seconded by Councilman Beckerink to pay Abstract #9 in the amount of $87,666.34 and charge to the proper funds or accounts.
