Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
May 17, 2004
at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Miller, Councilman Pickett, Councilman Taylor, Town Clerk Erlandson, Attorney Lasker.
Absent: Highway Superintendent Shellhouse.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Taylor, seconded by Councilman Miller to accept the minutes of
the May 3, 2004 meeting as presented by the Town Clerk.
Village of Celoron Mayor, Richard
Slagle, asked the Town Council about the possibility of negotiating a
“shared service” agreement between Celoron & the Town of Ellicott re code
enforcement services. Mr. Slagle noted
that Town of Ellicott Code Enforcement Officer Randy Woodbury has been
assisting the Village of Celoron with code enforcement since January 2004. In his opinion, a “shared service” agreement
would better serve both municipalities.
Mr. Slagle also pointed out that the Village of Falconer might also be
interested in sharing code enforcement services. The Council discussed the matter. Supervisor Tyler appointed Councilmen Geisler & Miller to
look into negotiating “shared service” agreements with Celoron & Falconer.
Town Clerk Erlandson read the following items into
the record:
1.
Notification
re an upcoming Regional Leadership Academy at So. Tier West Regional
Planning & Development Board.
2.
Invitation
to the annual Falconer Memorial Day Parade.
3.
Invitation
to an appreciation breakfast to be held at Sam’s Club on May 20, 2004.
4.
Invitation
to Meals on Wheels open house and barbecue on May 28, 2004.
TOWN OFFICERS’ REPORTS
Councilman Miller asked the Council about the possibility of
establishing four-year terms for elected officials in the Town of
Ellicott. In his opinion, the current
two-year terms are too short. He also
pointed out that term extensions would be subject to voter referendum. The Council discussed the matter & directed
Attorney Lasker to look into the procedure involved in extending the terms.
Mr. Miller also reported that the Town of Ellicott
Information Technology Committee met on May 7, 2004. He explained that the Town’s computer server is in poor condition
& should be replaced. He stated
that the committee is looking into options for replacing the server.
Councilman Taylor reported on a drainage problem on property
located at the corner of Idlewood Dr. & Hunt Rd. owned by Vincent &
Marilyn Gerace. Mr. Taylor intends to
meet with Highway Superintendent Shellhouse and Chautauqua Co. DPW officials to
determine how to alleviate the problem.
Mr. Taylor also stated that several residents on School
Ave. have reported low water pressure problems.
Town Clerk Erlandson reported that the Free
Rabies Vaccination Clinic conducted at the Ellicott Highway Garage on May 11,
2004 was a success. He reported that
approximately 300 animals were immunized.
He thanked Dr. Shannon Carlberg for volunteering her time to administer
the vaccinations. He also thanked the
other volunteers who assisted in conducting the clinic.
Accept Bids for New Roller – Tabled until the
June 7, 2004 meeting.
Water Service on Orchard Rd.
–
Tabled until the June 7, 2004 meeting.
Reduction of DEC Office
Space –
Town Clerk Erlandson reported that representatives from the New York State
Dept. of Environmental Conservation will be visiting the Town of Ellicott
offices on May 20, 2004 to inspect the ground floor of the
Administration Building. He reminded
the Council that the DEC is interested in re-locating their existing
offices from the third floor to the ground floor currently occupied by the
Ellicott Police Dept. The Police Dept.
would move to the third floor (Minutes 4/19/04 et. seq.). Mr. Erlandson invited the Ellicott Bldg.
Committee to be present when the DEC officials examine the building. He also reported that the upgrades to the
building that would be needed to accommodate the moves would not cost more
than $10,000.00.
NEW BUSINESS
Vacancies on South & Center Sewer Board –
Town Clerk Erlandson reported that there are three vacancies on the South &
Center Sewer Board. He explained that,
ideally, West Ellicott, Celoron or Fluvanna residents should fill the
positions. The Council asked Mr.
Erlandson to obtain more information re the openings.
Supervisor Tyler read a Proclamation declaring July 16, 2004 to be Laurel
Run Day in the Town of Ellicott.
RESOLUTION #81-04
Refund Site Plan Fee (Church
of Christ)
Motion by Supervisor Tyler, seconded by Councilman Taylor to refund the site
plan fee of $250.00 to Church of Christ, 875 Fairmount Ave. WE.
RESOLUTION #82-04
Change Dates of Council
Meeting
Motion by Supervisor Tyler, seconded by Councilman Geisler to change the
Regular Town Council Meeting scheduled for June 21, 2004 to June 28, 2004 and;
further, to cancel the Regular Town Board Meeting scheduled for July 5, 2004.
RESOLUTION #83-04
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Pickett to pay 2004 current claims #534-595,
inclusive, in the amount of $59,435.28 and charge to the proper fund or
account.
