Minutes of a Regular Meetin= g of the

Town Council of the Town of= Ellicott

held at = the Administration Building,

215 S. Work Street, Falconer, N.Y. on

May 19, = 2008 at 7:00 P.M.

 

Present: Supervisor Miller, Councilman Orlando= , Councilman Beckerink, Councilman Lodestro, Councilman Heintzelman, Town Clerk Erlandso= n, Highway Superintendent Shellhouse, Attorney Wright, Police Chief Ohnmeiss, Legislat= or Barmore.

 

Supervisor Miller open= ed the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called t= he roll. 

 

APPROVAL OF MINUTES

 

MOTION by Councilman Lodestro, seconded by Councilman Beckerink to accept the minu= tes of the May 5, 2008 meeting as presented by the Town Clerk.

PRIVILEGE OF THE FLOOR

 

Legi= slator Barmore discussed the recent in= crease in the Chautauqua County “bed tax”.  He pointed out th= at approximately $150,000.00 of the bed tax revenue is available to municipali= ties for waterway improvement projects.  He encouraged the Town to apply for funding.

        &= nbsp;   Town Clerk Erlandson read the following items into the record:=

TOWN OFFICERS’ REPORTS

 

Counc= ilman Lodestro reported on the status of upgrades to the entrance on the north side of the Town of Ellicott Administration Building.  He stated that automatic door open= ers and new signage still need to be installed in order to make the entrance accessible to persons with disabilities.&n= bsp; He noted that there is a possibility the door openers could be donat= ed.  He added that the Ellicott Facilit= ies Committee obtained two bids for the signage with the low bid being submitte= d by Chautauqua Sign Co. in the amou= nt of $1,986.00 including installation.  He stated that the committee intends to purchase the signage.

 

Counc= ilman Beckerink reported that the Ellicott Budget Committee met on May 7, 2008.  He discussed the most r= ecent budget report.  He stated that= , to date, expenditures are mostly within projected budgeted amounts. 

 

Mr. B= eckerink also reported that he recently attended a Chautauqua Co. Industrial Development Agency (IDA) meeting.

 

Town Clerk Erlandson reported that the Tow= n of Ellicott would be sponsoring a free rabies vaccination clinic on Thursday June 12, 2008 from = 6:00 – 8:00 PM at the Ellicott Highway Garage.

 

Attor= ney Wright reported that the Ellicott Planning Board has made a recommendat= ion re a request by the Town Council to review Section 146-42 of the Ellicott C= ode regarding “permitted uses” in Industrial Parks.  (Minutes 1/21/08)  He gave the Council a letter from Planning Board Chairman Daniel Evans re the matter.  Mr. Wright explained that the Plan= ning Board recommended that the code not be changed at the present time.  The Council expressed a number of concerns re the Planning Board’s recommendation.  Several Council members feel that = the zoning in Industrial Parks should be less restrictive in order to allow cer= tain types of businesses not currently permitted under the existing code.

 

Super= visor Miller reported that the BAN for the Buffalo-Willard Water District in = the amount of $642,600.00 was renewed on May 15, 2008.  He stated that the BAN was purchas= ed by JP Morgan Chase at an interest rat= e of 2.31%.

 

Polic= e Chief Ohnmeiss gave a status report concerning the activities of the Town of = Ellicott Police Dept. for the first four months of 2008.  He distributed several reports outlining specific details re police activity.<= span style=3D'mso-spacerun:yes'>  Chief Ohnmeiss discussed the repor= ts and answered questions from the Council.

 

Chief Ohnmeiss reported that he has received complaints from residents about motorists exceeding the speed limit on Old Fluvanna Rd.  He stated that the police departme= nt has recently been conducting speed checks in the area but have not observed an excessive speeding problem.  H= e also discussed a request to install a stop sign at the intersection of Old Fluva= nna Rd. & Bentley Ave.  Mr. Oh= nmeiss does not feel a stop sign is necessary.

 

Chief Ohnmeiss also reported that the Ellicott Police Dept. will provide sufficient manpower for the upcoming Rib Cook-off & Music Festival that will take place in Celoron on June 6= -8, 2008.

 

OLD BUSINESS

 

Comprehensive Plan - Councilman Heintzelman reported that the Ellicott Zoning Commission met on May 15, 2008.  The commission discusse= d how to proceed with a proposed comprehensive plan for the Town of Ellicott.  (Minutes 5/5/08)  He reminded the Town Council that approximately $30,000.00 is available for the comprehensive plan and that an additional $10,000.00 is still needed.&nbs= p; However, he stated that the company the commission selected to condu= ct the comprehensive plan has agreed to complete the first six (6) phases of t= he project for $30,000.00.  Mr. Heintzelman pointed out that it would probably take the rest of the year to complete the first 6 phases of the plan.&n= bsp; This would give the Town time to raise the remaining $10,000.00.  The Zoning Commission recommended = that the Town move ahead with the project. 

 

RESOL= UTION #58-08

Ret= ain Clark Patterson Lee (Comprehensive Plan)

MOTIO= N by Councilman Heintzelman, seconded by Councilman Orlando to retain the servic= es of Clark Patterson Lee, Rochester, New York to conduct the first six (6) phases of a comprehensive plan for the Town of Ellicott at an in= itial cost not to exceed $30,000.00.  (See ‘Zoning Commission’ file for detail)

Dog Control Ordinance – Councilman Lodestro presented a draft of a proposed dog ordinance for the T= own of Ellicott.  Police Chief Ohnmeiss outlined the= main facets of the proposed ordinance.  He stressed that the ordinance is not a “leash law”.  He pointed out that its purpose is= to impose certain restrictions on the “running-at-large” of dogs within the Town and compel dog owners to take responsibility for their dogs.  Chief Ohnmeiss feels th= at a dog ordinance is needed in the Town.  The Council discussed the proposal and asked Attorney Wright to revi= ew it.  Tabled pending further review.

 

   &nbs= p;            N= EW BUSINESS

 

Agreement w/ Chautauqua Lake Association<= /i> Supervisor Miller reported that he would be signin= g an agreement between the Town of = Ellicott and the Chautauqua Lake Association stipulating that the Town pay the CLA the amount of $10,000.00 for a lake maintenance program conducted in 2008.  (see ‘Chautauqua Lake Associ= ation Agreement’ file for detail)

 

Purchase New Stump Grinder – Highway Superintendent Shellhouse reque= sted permission to purchase a new stump grinder with the = Village of Falconer= , Town of Carroll & Town of Poland.  He explained that the four municipalities would equally share the co= st of the purchase.  The cost to = the Town would be $6,436.00.  The Council authorized the purchase.
