Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
May 21, 2007
at 7:00 P.M.
Present: Supervisor Tyler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Wright.
Absent: Councilman Geisler, Councilman Miller.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Heintzelman, seconded by Councilman Pickett to accept the minutes
of the May 7, 2007 meeting as presented by the Town Clerk.
Terri Holmes, 48 Huxley, Jamestown, NY
reported on a drainage problem on her property. Highway Superintendent Shellhouse explained that the problem
could be alleviated by cleaning out a storm sewer located in the Town of
Ellicott behind her property & Highway will look into the matter.
Town Clerk Erlandson read the
following items into the record:

Notice
re the annual Village of Falconer Memorial Day Parade to be held on May
28, 2007.
2.
Notice
re a free rabies vaccination clinic to be held in the Town of Ellington.
3.
Notice
re an upcoming joint meeting of the Chautauqua County Conference of Mayors and
the Chaut. Co. Town Supervisor Assn.
4.
Notification
re a “landowners dinner” sponsored by the Ellery Sno Cruisers to be held
at the War Vets Recreation Club on June 1, 2007.
5.
Dog
Control Incident Reports: March & April 2007.
Town Clerk Erlandson reported that the Town of
Ellicott would be sponsoring a free rabies vaccination clinic on Thursday June
14, 2007 from 6:00 – 8:00 PM at the Ellicott Highway Garage.
Highway Superintendent Shellhouse reported that the Jamestown Board of Public
Utilities has nearly completed the installation of six (6) new fire
hydrants along N. Main St. Ext. (Rte. 60).
He stated that the Ellicott Highway Dept. would be conducting the
restoration work.
Supervisor Tyler reported that the Town would be receiving $25,000.00 in “member-item” funding from NYS Senator Catherine Young for the construction of a new pump station in the School Ave. area (Minutes 5/7/07). Mt. Tyler thanked Councilman Heintzelman for his role in obtaining the funding.
Mr. Tyler also reported that he and Town Clerk Erlandson attended a meeting of the Chautauqua Lake Management Commission earlier today. He noted that the CLMC & the US Army Corps of Engineers would be spending several days studying the weed problem on Chautauqua Lake.
RESOLUTION #57-07
Accept Bids (Highway Materials & Services)
Motion by Supervisor Tyler, seconded by Councilman Pickett to accept (upon the recommendation of the Ellicott Highway Superintendent) bids for gravel products from Waterboro Gravel Products and Tri-James Services.

Chautauqua Lake Local Waterfront Revitalization
Program – Town Attorney Wright commented on the Chautauqua Lake Inter-Municipal Draft Local Waterfront Revitalization
Program (LWRP). (Minutes
3/19/07 et. seq.) He reported that the public comment period for the LWRP has expired.
He noted that at some point the nine municipalities affected by the
program could be asked to “adopt” the LWRP. He pointed out that the LWRP would
create an additional “layer” of government & might have certain
implications for potential commercial development. The Town Council asked a number of questions concerning the LWRP. Tabled until further notice.
Request for Rezoning (N. Main St. Ext.) –
The Council discussed a plan to rezone a
section of property east of North Main St. Ext. (Rte. 60) to ‘mercantile’.
Whereas there are approximately fifty-five (55) acres of ‘Residential’ zoned
land east of the ‘Mercantile’ Zone on North Main Street Extension (Rte. 60),
and
Whereas the Ellicott Town Council desires to consider expanding the
‘Mercantile’ Zone to include the ‘Residential’ Zone between the Mercantile Zone
and the ‘Agricultural-Residential’ Zone on the easterly side of N. Main St.
Ext.,
Now, therefore,
Motion by Supervisor
Tyler, seconded by Councilman Heintzelman to submit this issue to the Ellicott
Planning Board for its review and recommendation within sixty
(60) days of this referral, pursuant to Ellicott Town Code Section 146-78-A.

Wadsworth, 15 Columbia Ave. WE, as a part-time
Town of Ellicott Police Officer, effective May 21, 2007, at a starting rate of
pay of $11.91 per hour and subject to a one-year probation.

Motion by Supervisor Tyler, seconded by Councilman Pickett to hire Kevin
Darling, 122 N. Gifford WE as a part-time
Town of Ellicott Police Officer, effective May 22, 2007, at a starting rate of
pay of $11.91 per hour and subject to a one-year probation.
RESOLUTION #61-07
Advertise for Bids (Pump Skid)
Motion by Supervisor Tyler, seconded by Councilman Heintzelman authorizing the
Ellicott Highway Superintendent to advertise
for bids for a pump skid for the new pump station on School Ave., bids to
be returned no later than June 18,
2007 at 10:00 AM.

Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Pickett to pay 2007
current claims #531-576, inclusive, in the amount of $72,813.66 and charge
to the proper fund or account.
