Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
June 3, 2002
at 7:00 P.M.
Present: Supervisor Tyler, Councilman Lodestro, Councilman Miller, Councilman Taylor, Town Clerk Erlandson, Attorney Lasker, Police Chief Vanstrom, Legislator Spicer.
Absent: Councilman Geisler, Highway Superintendent Shellhouse.
Supervisor Tyler opened the
meeting at 7:00 and led the Town Council in the Pledge of Allegiance. Town Clerk
Erlandson called the roll.
APPROVAL OF MINUTES
Motion
by Councilman Taylor, seconded by Councilman Miller to accept the minutes of
the May 20, 2002 meeting as presented by the Town Clerk.
Town Clerk Erlandson read the
following items into the record:
1.
Certificate
of Satisfaction from Chautauqua County Real Property Tax Services re the 2002
Town of Ellicott Tax Warrant.
2.
Letter
from Patricia Martonis, 3060 Girts Rd., thanking Town of Ellicott Police
Officer JM Jaroszynski.
3.
Letter
from Western New York & Pennsylvania Railroad LLC, commending the
Town of Ellicott Police Dept. for its quick response to a recent vandalism
incident.
4.
Letter
from the Falconer Public Library thanking the Ellicott Police Dept. for
its prompt response re a recent incident.
5.
Letter
from the Chautauqua Lake Partnership thanking the Ellicott Town Council
for its $2,000.00 contribution to the Burtis Bay weed cleanup fund.
6.
Notice
from the Chaut. Co. Dept. of Health re several upcoming free animal rabies
vaccination clinics.

TOWN OFFICERS’ REPORTS
Councilman Lodestro thanked Ellicott Code Enforcement Office Randy Woodbury for resolving several code enforcement matters in Mr. Lodestro’s ward.
Councilman Lodestro commented on a current personnel matter involving the Town of Ellicott assistant deputy clerk. Mr. Lodestro explained that three different departments within the Town currently are utilizing the assistant deputy clerk’s services: the Police Dept., Code Enforcement Office & Town Clerk’s office. In his opinion, the assistant deputy clerk’s salary should be increased immediately commensurate with the duties & responsibilities. He noted that the Town has invested many hours training this employee. He also pointed out that the Town has no specific policy re non-union, non-management employees. Cecil Miller stated that a committee was recently formed to review past practices and develop a non-union labor policy (minutes 4/15/02). He explained that the committee also intends to review salary matters. Mr. Miller expressed his concerns that monies for increasing the assistant deputy clerk’s salary are not allocated in the fiscal 2002 budget. He recommended that the salary for the position be increased only incrementally at the present time. He stated that the salary situation could be addressed as the 2003 budget is being prepared. Supervisor Tyler stated that the additional monies could be allocated from the Safety Inspection - Contractual budget (B3620.4). The Council discussed the matter.
RESOLUTION #98-02
Increase Salary of Assistant
Deputy Clerk (Okerlund)
Motion by Councilman Lodestro, seconded by Supervisor Tyler to increase the
salary of the Town of Ellicott Assistant Deputy Clerk to $15.12 per
hour, effective June 5, 2002 and; further, that funds for the salary increase
be allocated from Account #B3620.4 (Safety Inspection – Contractual)
Town Clerk Erlandson reported that his office has commenced Village of Falconer tax collection operations.
Supervisor
Tyler reported that the Chautauqua
Co. Supervisors & Mayors Association is looking into the possibility of creating a special Lake District to
deal with future matters concerning Chautauqua Lake.
OLD BUSINESS
Burtis Bay Milfoil Problem – Supervisor Tyler reported that the Town of Ellicott expects to receive a permit from the New York State Dept. of Environmental Conservation for a proposed aquatic herbicide project in Burtis Bay.
Water Service on Camp St.
Ext. –
Councilman Lodestro reported that the preliminary engineering study for
extending municipal water service to a section of Camp St. Ext. has been
completed. He noted that the total cost
of the project would not exceed $145,000.00.
Motion
by Councilman Lodestro, seconded by Councilman Miller to schedule a Public
Hearing for June 17, 2002 at 7:00 PM regarding the proposed extension of municipal water service to
Camp St. Ext., east of Swanson Road.
Water Service on Orchard Rd.
– Tabled pending
completion of a preliminary engineering study.
NEW BUSINESS
RESOLUTION #99-02
Purchase of New Air
Conditioner for Police Dept.
Motion by Supervisor Tyler, seconded by Councilman Taylor to accept a bid
from King’s Heating, Falconer, in the amount of $4,986.00 for the
purchase of a new air conditioning unit for the Town of Ellicott Police
department.
Transfer of Current Engineering Projects to Tolman Engineering – Supervisor Tyler reported that Engineer Rex Tolman resigned from Bacik, Karpinski Associates, effective May 31, 2002. Mr. Tyler recommended that four open projects currently being administered by Bacik, Karpinski be transferred to Tolman Engineering.

Tolman Engineering, effective June 16, 2002.

RESOLUTION #101-02
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Miller to pay 2002 current claims #683-719,
inclusive, in the amount of $15,441.21 and charge to the proper fund or
account.
