Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

June 16, 2003 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Geisler, Councilman Lodestro, Councilman Miller, Councilman Taylor, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker.

 

Supervisor Tyler opened the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called the roll. 

 

APPROVAL OF MINUTES

 

Motion by Councilman Taylor, seconded by Councilman Lodestro to accept the minutes of the June 2, 2003 meeting as presented by the Town Clerk.

CORRESPONDENCE

 

            Town Clerk Erlandson read the following items into the record:

 

1.      Invitation to Celoron Hose Co. Open House & Dedication on June 21, 2003.

2.      Designation of Restricted Highway: Chautauqua County Rte. 380.

3.      2002 Annual Report: Chautauqua Co. IDA.

4.      Falconer Fire Dept. Incident Report: April & May 2003.

           

OLD BUSINESS

 

Permit for Herbicide Application (Chautauqua Lake) – Supervisor Tyler reported that the New York State Dept. of Environmental Conservation has denied a permit to the Town of Ellicott for applying herbicides to certain sections of Chautauqua Lake.  Mr. Tyler noted that the DEC outlined its position in a recent (see ‘Burtis Bay Milfoil’ file for detail).  The Town Council discussed the matter.  Mr. Tyler stated that members of the Chautauqua Lake Partnership & representatives from the Town of Ellicott intend to meet with DEC officials to discuss the DEC’s decision.

 

Lyndon Blvd. Reconstruction Project - Councilman Lodestro reported on the status of repairs re several breaks in the sewer line along Lyndon Blvd. (Minutes 4/7/03 et. seq.) He stated that Project Coordinator Rose Wightman is working on resolving the matter.

 

Notice of Defect (Lindquist) – The Town Council discussed a letter received from Alan Lindquist, 3367 Strunk Rd., requesting that he be reimbursed for damage to his truck.  Mr. Lindquist claims that the damage was caused by the poor condition of Strunk Rd.  The Council denied the request.  Town Clerk Erlandson was directed to notify Mr. Lindquist re the Council’s decision.

 

Home Rule Legislation (Chautauqua Lake Protection & Improvement District) – Supervisor Tyler reported that the Chautauqua County Supervisors Association would be drafting a revised version of a proposed home rule law re the formation of a Chautauqua Lake Protection & Improvement District.  Tabled until further notice.

 

Water Service on Camp St. Ext. – Highway Superintendent Shellhouse reported that the project has been completed.

 

Water Service on Orchard Rd. – Highway Superintendent Shellhouse reported that the survey for a proposed municipal water line on Orchard Rd. has been completed.  Supervisor Tyler will meet with Town of Busti & Village of Lakewood officials to determine a water rate.

 

Traffic Study (Allegheny Ave. & Hunt Rd.) – Councilman Geisler asked about the status of a traffic study requested by Southwestern Central School officials.  School officials have asked that the study be conducted on the area in the vicinity of school property – particularly the Allegheny Ave./Hunt Rd. intersection.  The officials are concerned about the safety of its students.  Councilman Geisler read part of a letter that he addressed to the principal of SWC High School.  Mr. Geisler pointed out that school officials should have addressed traffic-flow issues during construction of the new elementary school.  The Council discussed the school’s request.  Supervisor Tyler noted that a traffic study couldn’t be conducted until school is back in session in early September.  He will remain in contact with school officials re the matter.

 

NEW BUSINESS

 

Redistricting of Election Districts – Town Clerk Erlandson reported that the Chautauqua Co. Board of Elections has completed the redistricting of the Town of Ellicott election districts.  The Council reviewed the new districts. 

 

RESOLUTION #93-03

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Miller to pay 2003 current claims #651-718, inclusive, in the amount of $54,216.95 and charge to the proper fund or account.

Motion by Supervisor Tyler, seconded by Councilman Taylor to adjourn at 7:25 PM.
