Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
June 18, 2007
at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Wright.
Absent: Councilman Pickett.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Miller, seconded by Councilman Heintzelman to accept the minutes
of the June 5, 2007 meeting as presented by the Town Clerk.
James Carlson, 2996 N. Main St., asked
about the status of a proposed request to rezone 55 acres of property located
east of Route 60. (Minutes
5/21/07) Supervisor Tyler stated that
the Ellicott Planning Board is currently reviewing the matter and will make a
recommendation to the Ellicott Town Council in July 2007.
Town Clerk Erlandson read the
following items into the record:

Notice
re an upcoming Public Hearing in the Village of Lakewood.
2.
Notification
of Liquor License Renewal: Herman Kent Post #777 American Legion, 26
Jackson Ave. WE.
TOWN OFFICERS
Councilman Heintzelman reported that he met with
the owners of a property located in the School Ave. area. Mr. Heintzelman explained that the Town of
Ellicott is interested in acquiring the property in conjunction with the
construction of a new water pump station in the area. (Minutes 5/7/07) Highway
Superintendent Shellhouse noted that acquiring the property would allow the
pump station to be located further away from residences in the area. According to Mr. Heintzelman, the owners are
interested in selling the property to the Town of Ellicott for three thousand
dollars ($3,000.00).
RESOLUTION #65-07
Purchase Property for Water Pump Station (Gustafson/Paterniti)
Motion by Supervisor Tyler, seconded by Councilman Miller authorizing the
Ellicott Town Council to purchase Town of Ellicott tax map parcel
Section 386.16, Block 3, Lot 44 owned by Kurt Gustafson, Margaret Gustafson,
Greg Paterniti and Diane Paterniti at a cost to the Town of Ellicott of
$3,000.00.
Adopted.

Note -- Attorney Wright will draft a contract for
the purchase of the property.
Councilman Geisler asked Highway
Superintendent Shellhouse about the status of a retention pond on Southwestern
Dr. near Southwestern Central School.
Mr. Geisler also commented on the new Starbucks
that recently opened on Fairmount Ave. He noted that it is an excellent
facility. He commended the Town of
Ellicott Planning Board for its efforts during the planning stages of the
project.
Town Clerk Erlandson reported that a free rabies
vaccination clinic was conducted at the Ellicott Highway Garage on
Thursday June 14, 2007. He stated that
nearly 350 animals were vaccinated.
Highway Superintendent
Shellhouse
reported that the Chautauqua County Health Dept. has approved plans for
the proposed new water pump station on School Ave.
RESOLUTION #66-07
Environmental Assessment (Pump Station on School Ave.)
Motion by Supervisor Tyler, seconded by Councilman Heintzelman that the
proposed construction of a new water pump station in the School Ave. area will
have no significant adverse environmental impacts. (see ‘Pump Station on School Ave.’ for
detail)

NEW BUSINESS
Grant Funding for Town Court
- Town
of Ellicott Justice Marilyn Gerace addressed the Town Council. She explained that the New York State Office
of Court Administration would be conducting a security assessment of
the Ellicott Court facilities sometime in the near future. She stated that grant monies are
currently available to upgrade security in municipal justice courts. The OCA is administering the grant
funding. Justice Gerace added
that each municipal court is eligible for up to $30,000.00 in grant
monies. She explained that
authorization from the Council is needed in order to apply for the grant. She asked the Council for permission to
apply for the grant. She outlined the
security equipment she would be requesting in the grant application. In her opinion, at the present time,
security in the Town of Ellicott Court is inadequate. The Council asked a number of questions re the proposed
grant. The Council will review copies of
the grant application as well as a list of the items that Justice Gerace intends
to request. Justice Gerace noted that
the grant deadline is August 31, 2007. Tabled
until the July 2, 2007 Town Council meeting.
RESOLUTION #67-07
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Heintzelman to pay 2007
current claims #617-665, inclusive, in the amount of $87,254.15 and charge
to the proper fund or account.
