Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
July 2, 2007
at 7:00 P.M.
Present: Supervisor Tyler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson.
Absent: Councilman Geisler, Highway Superintendent Shellhouse.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Miller, seconded by Councilman Heintzelman to accept the minutes
of the June 18, 2007 meeting as presented by the Town Clerk.
Patricia Lefford, 2717 Palm Rd. read a
statement regarding a request to rezone 55 acres of property east of N. Main
St. Ext. (Rte. 60). If the request is
granted, the property would be rezoned from ‘residential’ to ‘mercantile’. Ms. Lefford is opposed to rezoning the
property. In her opinion, ‘mercantile’
does not fit the character of the present neighborhood. She expressed a number of concerns re the
proposed rezoning request.
Susan Carlson, 2709 Horton Rd., also
stated that she is opposed to the rezoning request. She is concerned that a commercial development in the area would
increase truck traffic on Horton Rd.
She also pointed out that much of the area within the rezoning area is
wetland. She feels that the wetland
should be preserved.
Town Clerk Erlandson read the
following items into the record:

Notice
from So. Tier West Regional Planning & Development Board re an
upcoming training program on property tax assessments.
2.
Notice
from the City of Jamestown Zoning Board of Appeals re an upcoming Public
Hearing.
3.
Dog
Control Incident Report: May 2007.
4.

Chautauqua Co. Chamber of Commerce.
TOWN OFFICERS’ REPORTS
Councilman Pickett reported that John Piazza
would be retiring from the Town of Ellicott Highway Dept. in two weeks. He thanked John for his 28 years of service
to the Town of Ellicott.
Supervisor Tyler reminded the Town Council
that Town of Ellicott Assessor’s term would be expiring on October 1,
2007. He explained that the Assessor would
have to be re-appointed prior to that date.
RESOLUTION #68-07
Grant Application Request (Town of Ellicott Justice Court)
MOTION
by Supervisor Tyler, seconded by Councilman Miller authorizing the Town of
Ellicott Supervisor to sign a New York State Justice Court Assistance
Program Grant Application to be used for upgrading the Town of
Ellicott Court offices to improve security, acquire essential equipment and to maintain a
dignified appearance.
Adopted.

RESOLUTION #69-07
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Heintzelman to pay 2007
current claims #673-725, inclusive, in the amount of $52,913.08 and charge
to the proper fund or account.
