Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
July 18, 2005
at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse.
Absent: Councilman Pickett.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Heintzelman, seconded by Councilman Miller to accept the minutes
of the June 20, 2005 & June 23, 2005 meetings as presented by the Town
Clerk.
Town Clerk Erlandson read the
following items into the record:
1.
Letter
from Philip Orazi III, Jamestown, New York, informing the Town Council that he
intends to purchase the Apple Inn, 3373 Old Fluvanna Rd. & that he
has also submitted an application for a liquor license for the property.
2.
Notification
of liquor license renewal: AMVETS, 3155 Fluvanna Ave.
3.
Letter
from NYS Dept. of State that Town of Ellicott Local Law #3-2005 has been
received & filed.
4.
Notification
re an upcoming Regional Leadership Academy seminar to be conducted at Southern
Tier West Regional Planning & Development Board.
5.
Falconer Fire Dept. Incident Report: January – June 2005.
6.

Chautauqua County Chamber of Commerce.
7.
Newsletter:
Chautauqua Co. Fire Service.

Annual

TOWN OFFICERS’ REPORTS
Town Clerk Erlandson reminded the Council that a
free rabies vaccination clinic will be conducted at the Ellicott Highway Garage
on July 26, 2005 from 6:00 - 8:00 PM.
Supervisor Tyler reported that parts of
Fairmount Ave. (Rte. 394) are currently being repaired. He advised people to avoid the highway as
much as possible while the repairs are being conducted.
OLD BUSINESS
Draft Environmental Impact
Statement (Burtis Bay) – Supervisor Tyler stated that a Draft
Environmental Impact Statement (DEIS) being prepared in conjunction with a Submerged
Aquatic Vegetation (SAV) Management Plan for the South Basin of Chautauqua
Lake is not ready for review.
However, Mr. Tyler explained that the SAV could be adopted.
RESOLUTION #76-05
Draft Submerged Aquatic
Vegetation Management Plan (Burtis Bay)
Motion by Supervisor Tyler,
seconded by Councilman Geisler to accept a Draft Submerged Aquatic
Vegetation (SAV) Management Plan for the purpose of managing submerged
aquatic vegetation in the South Basin of Chautauqua Lake. (See ‘Burtis Bay – Draft Environmental
Impact Statement’ file for detail)
Local Waterfront Revitalization Program –The
Council will continue to review a draft
of a proposed Local Waterfront Revitalization Program (LWRP). Members of the Chautauqua Co.
Planning Dept. will be asked to clarify certain sections of the
document. Tabled pending further
review.
School Resource Officer –
Supervisor Tyler reminded the Council that both Southwestern Central School
and Falconer Central School have requested the Ellicott Police Dept. to
provide a School Resource Officer. (Minutes 6/20/05) Mr. Tyler commented on the request. He noted that the Town would not be required to fund the SRO position.
He stated that Ellicott Police Chief Ohnmeiss is continuing to look into
the feasibility of providing an SRO.
The Council asked several questions re the matter.
RESOLUTION #77-05
Advertise
for Bids (Dump Body & Plow Equipment)
Motion by Supervisor Tyler, seconded by Councilman Miller authorizing the
Ellicott Highway Superintendent to advertise for bids for a new dump
truck body and plow equipment; bids to be returned no later than August
11, 2005 at 10:00 AM.
Adopted. Ayes - 4 Noes - 0 Absent - 1
Speed Limit on Ross Mills Rd. –
Highway Superintendent Shellhouse reported that he is preparing forms to submit
to the Chaut. Co. Dept. of Public Works and the NYS Dept. of
Transportation requesting a reduction of speed limits
on the following roads: Ross Mills Rd., E. Ross Mills Rd., Knight Rd., Wilson
Hollow Rd., & Harris Hill Rd. He
asked the Council for permission to move submit the requests.
RESOLUTION #78-05
Reduce
Speed Limits on Certain Roads
Motion by Supervisor Tyler, seconded by Councilman
Geisler authorizing the Ellicott Highway Superintendent to request a reduction in speed limits on Ross Mills Road, East
Ross Mills Road, Knight Road, Wilson Hollow Road and Harris Hill Road.
Adopted. Ayes - 4 Noes - 0 Absent – 1
NEW BUSINESS
Library Taxing District – Supervisor
Tyler reported on a proposal to create a special library-taxing district for the James Prendergast Library
located in Jamestown. He explained that
the proposed district would include West Ellicott and the Village of
Celoron. Mr. Tyler noted that a public referendum re the matter will be held on Sept. 20,
2005. Councilman Geisler expressed
concerns about the proposal. He stated
that he is opposed to the formation of the library-taxing district. In his opinion, West Ellicott & Celoron
residents should not be compelled to fund the library.
RESOLUTION #79-05
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Heintzelman to pay 2005
current claims #720-832, inclusive, in the amount of $74,618.50 and charge
to the proper fund or account.
Adopted. Ayes - 4 Noes - 0 Absent – 1
