Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

August 2, 2004 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Miller, Councilman Pickett, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Legislator Spicer. 

 

Absent: Councilman Geisler.

 

Supervisor Tyler opened the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called the roll. 

 

PUBLIC HEARING (Establishment of Sewer Rents)

 

Supervisor Tyler opened a Public Hearing regarding the establishment of sewer rents for the use of the sewer system within the Town of Ellicott outside the Village of Falconer served through the Village of Falconer Sewer System.  No public comments were heard.

 

Motion by Supervisor Tyler, seconded by Councilman Miller to close the Public Hearing at 7:01 PM.

APPROVAL OF MINUTES

               

Motion by Councilman Miller, seconded by Councilman Pickett to accept the minutes of the July 12, 2004 meeting as presented by the Town Clerk.

PRIVILEGE OF THE FLOOR
 
Legislator Spicer commented on the recent monetary assessments imposed by the Chautauqua County Dept. of Insurance.  (Minutes 6/28/04 et. seq.)
 
CORRESPONDENCE

 

Town Clerk Erlandson read the following items into the record:

 

1.      Notice of liquor license renewal: Henry Mosher Post, Falconer American Legion, 132 West Main St., Falconer, New York.

2.      Letter from Sheldon Silver, Speaker of the N.Y. State Assembly re the Town of Ellicott’s support for the Collateral Source Bill (A.3483).  (Resolution #86-04)

3.      Notification from the Chautauqua Watershed Conservancy re upcoming presentations.

4.      Letter from Harold Almquist, 3207 W. Oak Hill Rd. requesting that the speed limit be reduced on W. Oak Hill Rd.

5.      Designation of Restricted Highway: Allen St. Ext. between S. Work St. & Mason Dr., effective Aug. 4, 2004.

6.      Invitation to the Annual Summer Wind Dinner Cruise sponsored by the Chautauqua Co. Conference of Mayors.

7.      Newsletter: Community Assistance Program.

8.      Falconer Fire Dept. Incident Report: April-June 2004.

 

TOWN OFFICERS’ REPORTS

 

Councilman Miller updated the Town Council re a recent meeting of the Ellicott Information Technology Committee.  He noted that the new computer server recently leased by the Town of Ellicott has been installed and is working well.  Mr. Miller stated that the committee is also looking into changing the Town’s web-hosting company.  In addition, the committee recommended that an Internet usage policy for Town employees be adopted.

 

Town Clerk Erlandson reported that the free rabies clinic conducted on July 17, 2004 at the Celoron Fire Garage was a success.  He noted that approximately 200 dogs and cats were immunized.

 

Highway Superintendent Shellhouse reported that he recently met with Southwestern Central School Superintendent Robert Guiffreda re the installation of signs and lights in the school zones along Hunt Rd. & S. Allegheny Ave.  He stated that the signs and lights should be installed later this month.

 

Supervisor Tyler asked about the status of establishing 4-year terms for elected officials in the Town of Ellicott (Minutes 5/17/04).  The Council decided not to pursue the matter at the present time.

 

Mr. Tyler also reported that the Ellicott Police Dept. is currently utilizing a computer provided by the Ellicott Police Chief.  The Council discussed whether to purchase the computer from the Chief.  The issue was tabled until the Aug. 16, 2004 meeting.

 

Mr. Tyler also discussed a letter he received from the Town of Chautauqua Supervisor proposing that the Town Highway Superintendent become an appointed rather than an elected position.  The Council decided not to pursue the matter.

 

Mr. Tyler stated that a meeting to discuss the future of the Chautauqua Co. Municipal Health Plan has been postponed until Aug. 19, 2004 at 10:00 AM.

 

Mr. Tyler also reported that the Town of Ellicott lost an arbitration hearing re a grievance filed by former Town of Ellicott Police Officer Timothy Johnson.

 

OLD BUSINESS

 

Water Service on Orchard Rd. Highway Superintendent Shellhouse reported that the Jamestown Board of Public Utilities recently installed the final two curb boxes on Orchard Rd.  He stated that the Ellicott Highway Dept. would complete the restoration work as soon as possible.

 

Reduction of DEC Office Space – Tabled pending further communication from DEC officials.

 

RESOLUTION #97-04

Establishment of Sewer Rents

 

Motion by Supervisor Tyler, seconded by Councilman Miller establishing sewer rents for the use of the sewer system within the Town of Ellicott outside the Village of Falconer served through the Village of Falconer Sewer System.  (See ‘Sewer Rents’ file for detail)

Status of Office Employee (Okerlund) – The Town Council discussed the status of Town of Ellicott office employee Karyn Okerlund.  Supervisor Tyler explained that Mrs. Okerlund is technically an appointed employee.  He recommended that the Council consider creating a civil service position for Mrs. Okerlund.  Tabled pending further review by the Ellicott Negotiating Committee.

 

Burtis Bay Milfoil Problem – Supervisor Tyler reported that the Town of Ellicott received permission from the N.Y. State Dept. of Environmental Conservation to conduct a test study of the effect of aquatic herbicide on milfoil in Chautauqua Lake.  He explained that the study would involve the application of the herbicide to four 3-acre sites in the southern basin of Chautauqua Lake. 

 

NEW BUSINESS

 

Establishment of Health Insurance Committee – Supervisor Tyler established a committee to look into employee health insurance issues.  The committee will consist of Councilman Geisler, Councilman Miller, Town Clerk Erlandson and representatives from both Town of Ellicott CSEA labor unions.

 

Permission to Teach at JCC (Code Enforcement Officer) - Mr. Tyler stated that Town of Ellicott Code Enforcement Officer Randy Woodbury has asked for permission to teach a class at Jamestown Community College during the Fall 2004 semester.  The class would be conducted on Tuesday and Thursday mornings.  Mr. Tyler explained that on class days Mr. Woodbury would conduct evening office hours at the Town of Ellicott.  The Council discussed the matter and agreed to allow Mr. Woodbury to teach the class.

 

RESOLUTION #98-04

Budget Transfers


Motion by Supervisor Tyler, seconded by Councilman Pickett authorizing Town of Ellicott Supervisor to make the following budget transfers:

 

Transfer the amount of $3,401.92 from Account #A1990.4 (Contingency) to Account #1420.4 (Attorney – Contractual); transfer the amount of $1,250.00 from Account #1620.4 (Buildings – Contractual) to Account #A1620.2 (Buildings – Equipment); transfer the amount of $74.97 from Account #A1620.4 (Buildings – Contractual) to Account #A1680.4 (Data Processing – Contractual); transfer the amount of $600.00 from Account #A1355.2 (Assessor – Equipment) to Account #A1355.4 (Assessor – Contractual); transfer the amount of $622.51 from Account #DB5110.4 (General Repairs – Contractual) to Account #DB5142.4 (Snow Removal – Contractual).

RESOLUTION #99-04

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Pickett to pay 2004 current claims #850-908 inclusive, in the amount of $49,688.45 and charge to the proper fund or account.

RESOLUTION #100-04

Convene Executive Session (Pending Litigation & Personnel Matters)

 

Motion by Supervisor Tyler, seconded by Councilman Pickett to Convene Executive Session for the purpose of discussing pending litigation and a personnel matter.

RESOLUTION #101-04

Change Meeting Time of Town Council Meeting

 

Motion by Supervisor Tyler, seconded by Councilman Miller to change the starting time of the August 16, 2004 Regular Town Council Meeting to 6:00 PM.
