Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

August 18, 2003 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Lodestro, Councilman Taylor, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker.

 

Absent: Councilman Geisler, Councilman Miller.

 

Supervisor Tyler opened the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called the roll. 

 

APPROVAL OF MINUTES

 

Motion by Councilman Lodestro, seconded by Councilman Taylor to accept the minutes of the August 4, 2003 meeting as presented by the Town Clerk.

PRIVILEGE OF THE FLOOR

 

Ms. Helen Sischo, 70 Jackson Ave., Celoron, thanked the Town of Ellicott Police Dept. & the Celoron Fire Dept. for their quick, professional response to a recent house fire on her street.

 

Mr. Robert Woodard, 257 E. Elmwood Ave., Falconer, commented on the Town of Ellicott’s involvement re the updating of a New York State Environmental Quality Review report in preparation for a proposed herbicide application on Chautauqua Lake in 2004.  Mr. Woodard asked the Council how much funding has been allocated to the SEQR process.  Supervisor Tyler explained that no monies have been allocated at the present time.

 

CORRESPONDENCE

 

            Town Clerk Erlandson read the following items into the record:

           

1.      Notification of liquor license renewal: Apple Inn, 3373 Old Fluvanna Rd.

2.      Notification of liquor license renewal: La Scala, 3202 Fluvanna Ave.

3.      Notice of upcoming teleconference with the New York State Comptroller.

4.      Newsletter: Chautauqua Co. Soil & Water Conservation.

           

TOWN OFFICERS REPORTS

 

Town Clerk Erlandson reported that he has successfully completed two assessing courses in 2003.  He noted that he has attended the courses on his own time and at his own expense.  Mr. Erlandson stated that he hopes to complete the seven-course curriculum in 2004.

Mr. Erlandson also reported that the Town of Ellicott recently received a request from Eagle Forest Products, Inc. for a temporary easement of a property located on Merlin Ave.  Highway Superintendent Shellhouse confirmed that the Town of Ellicott owns the property.  He explained that the company needs the easement to facilitate the removal of forest products on a property owned by the Colony Motel.  The Council discussed the request.  The Council decided to schedule a public hearing on Sept. 15, 2003 at 7:00 PM to get more information re the matter.  Town Clerk Erlandson will notify residents located within 500 ft. of the property about the public hearing.

 

Highway Superintendent Shellhouse reported that he is receiving price quotes for the removal of 10 – 12 trees in the Town of Ellicott.

 

Mr. Shellhouse also reported that the owners of two residences on Royal Oaks have requested municipal water service.  Mr. Shellhouse was directed to ask Engineer Rex Tolman to determine a cost estimate for the proposed water service.

 

OLD BUSINESS

 

RESOLUTION #104-03

Accept Bids (Plow, Dump & Sander Equipment)

 

Motion by Supervisor Tyler, seconded by Councilman Lodestro to accept the low bid of $36,746.00 submitted by Boyle Motor Sales Inc., Jamestown, New York, for the purchase of plow, wing and sander equipment for the Town of Ellicott Highway Department.

Contract w/ Ellicott Police Chief – Tabled until the Sept. 15, 2003 meeting.

 

Lyndon Blvd. Reconstruction Project – Councilman Lodestro reported that the breaks in the sewer line along Lyndon Blvd. have been repaired.  (Minutes 4/7/03 et. seq.)  He recommended that the Town of Ellicott accept ownership of the project area.

 

RESOLUTION #105-03

Acceptance of Lyndon Blvd.

 

Motion by Councilman Lodestro, seconded by Councilman Taylor authorizing the Town of Ellicott to accept ownership and control of the Lyndon Boulevard project area including the ancillary infrastructure.  (See ‘Lyndon Blvd. Project’ file for detail)

Water Service on Orchard Rd. – Highway Superintendent Shellhouse reported that he recently met with Chautauqua Co. officials concerning the placement of the new waterline along Southwestern Dr.  (Minutes 7/21/03)  Mr. Shellhouse stated that the installation of the waterline should get underway soon.  Supervisor Tyler reported that he met with Town of Busti, Village of Lakewood & Jamestown Board of Public Utilities officials to negotiate a rate for water usage for homeowners who decide to connect to the new waterline.  As a result of the negotiations, Mr. Tyler reported that homeowners who connect to the waterline would pay the same rate as all other Town of Ellicott residents who receive municipal water service.  He noted that this rate would be considerably less than the original estimated rate. 

 

Rte. 380 Rezoning – Supervisor Tyler reported that the Ellicott Planning Board recommended that a parcel of property located along Rte. 380 near Kimball Stand be rezoned ‘mercantile’ as requested by the property owner.  (Minutes 8/4/03)

 

Motion by Supervisor Tyler, seconded by Councilman Lodestro to schedule a Public Hearing for September 15, 2003 at 7:10 PM on introductory Town of Ellicott Local Law #2-2003 concerning the proposed rezoning of property located on Route 380 in the Town of Ellicott to ‘mercantile’.

Motion by Supervisor Tyler, seconded by Councilman Lodestro to schedule a Public Hearing for September 15, 2003 at 7:20 PM on introductory Town of Ellicott Local Law #3-2003 concerning the proposed rezoning of a section of Route 60 in the Town of Ellicott to ‘mercantile’.

Motion by Supervisor Tyler, seconded by Councilman Lodestro to schedule a Public Hearing for September 15, 2003 at 7:30 PM on introductory Town of Ellicott Local Law #4-2003 amending the permitted uses in ‘Professional Office’ zones within the Town of Ellicott.

Traffic Safety Concerns at Southwestern Central School – Supervisor Tyler reported that Town of Ellicott officials met with other municipal representatives at Southwestern Central School on Aug. 14, 2003.  The meeting was held to discuss potential traffic safety issues on roads around Southwestern Central School.  Mr. Tyler briefly summarized the issues addressed at the meeting.

 

RESOLUTION #106-03

No Parking Signs on Allegheny Ave.

 

Motion by Supervisor Tyler, seconded by Councilman Taylor to establish a “no-parking” zone on Allegheny Ave. beginning at the entrance to Southwestern Central School and extending three hundred (300) feet north and three hundred (300) feet south along Allegheny Ave. and; further, authorizing the Town of Ellicott Highway Department to put up “no-parking” signs within the no-parking zone.

RESOLUTION #107-03

Install Traffic Safety Lights on Allegheny Ave.

 

Motion by Supervisor Tyler, seconded by Councilman Taylor authorizing Highway Superintendent Shellhouse to install traffic safety lights on Allegheny Ave. provided that such lights can be obtained.

RESOLUTION #108-03

Request Reduction in Speed Limit (Hunt. Rd.)

 

Motion by Supervisor Tyler, seconded by Councilman Taylor requesting the New York State Department of Transportation to establish a maximum speed limit of 30 miles per hour on Hunt Road between the City of Jamestown line and Southwestern Drive and; further, requesting the New York State Department of Transportation to establish a school zone speed restriction of 20 miles per hour on Hunt Road beginning 160 feet east of Southwestern Drive, thence east 1280 feet and; further, requesting the New York State Department of Transportation to establish a school zone speed restriction of 15 miles per hour on Allegheny Avenue beginning 330 feet north of Hunt Road, thence north 840 feet.

BAN (Dump Truck)

 

Motion by Supervisor Tyler, seconded by Councilman Lodestro authorizing the issuance of a Bond Anticipation Note in the amount of $38,400.00 for the purchase of a 2001 International Paystar with Dump Body for the Ellicott Highway Department.  (see 'BAN' file for detail)

RESOLUTION #110-03

Ban Renewal (Water 1B)

 

Motion by Supervisor Tyler, seconded by Councilman Lodestro authorizing the issuance and sale of a Bond Anticipation Note in the amount of $25,400.00 for the construction of a Water Supply and Distribution System for Water District 1B of the Town of Ellicott.  (see 'BAN' file for detail)

RESOLUTION #111-03

Budget Transfers

 

Motion by Supervisor Tyler, seconded by Councilman Taylor authorizing Town of Ellicott Supervisor to make the following budget allocation:

 

Transfer the amount of $414.69 from Account #A1620.4 (Buildings – Contractual) to Account #A1680.4 (Data Processing – Contractual)

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Lodestro to pay 2003 current claims #920-972, inclusive, in the amount of $46,134.91 and charge to the proper fund or account.
