Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
August 20,
2007 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Wright.
Absent: Councilman Geisler.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Heintzelman, seconded by Councilman Pickett to accept the minutes
of the August 6, 2007 meeting as presented by the Town Clerk.
Brian Malta, Celoron, stated that he
recently received a citation from the Town of Ellicott Police Dept. He explained that the citation was issued
following a “citizen’s arrest” made by a Village of Celoron Trustee. Mr. Malta feels that Village of Celoron
officials are using the Ellicott Police Dept. to harass him. In his opinion, this is a misuse of police
resources. He feels that the police
dept. should not waste its time on frivolous complaints. He asked the Council to discuss the matter
with the Ellicott Police Chief.
Town Clerk Erlandson read the
following items into the record:

Notification
of Liquor License Renewals: Kerwin’s Bar, 34 E Main St., Falconer & House
of Petillo, 382 Hunt Rd.
2.
Designation
of Restricted Highway: Stubb Rd. between Girts Rd. & Turner Rd., effective
Aug. 13, 2007.
3.
Notice
from Women’s Services of Chautauqua County re the annual “walk for life”
to be held on Sept. 16, 2007.
4.
Notice
re an upcoming charitable “walk” to be held in Falconer on Aug. 25, 2007.
5.
Invitation
to annual Dinner Cruise on the Summer Wind sponsored by the Chautauqua
Co. Conference of Mayors & Supervisors.
6.
Notice
from the Chautauqua Co. Chamber of Commerce re an upcoming program on
National Workforce Education & Training.

TOWN OFFICERS’ REPORTS
Councilman Heintzelman commented on rezoning
requests. He feels that the fee
for submitting rezoning requests to the Ellicott Town Council should be
increased. He pointed out that the Town
often incurs significant expenses during the process of reviewing a rezoning
request. He noted that the current fee
is only $25.00, which does not cover the Town’s expenses. He asked the Council to consider increasing
the fee. Town Clerk Erlandson will find
out what other area municipalities are charging.
Mr. Heintzelman also asked the Town Clerk to
look into how much money has been spent on legal fees involving certain ongoing
litigation.
Mr. Heintzelman asked Highway
Superintendent Shellhouse about the status of the new pump station in the
School Ave. Area. Mr. Shellhouse stated
that construction should begin soon.
Town Clerk Erlandson reported that licenses for
the 2007-08 hunting season are currently on sale & can be obtained at his
office.
Supervisor Tyler asked Highway
Superintendent Shellhouse about the status of the reconstruction of Green St.
in conjunction with the closing of the Wicks Ave. Railroad
Crossing. (Minutes 12/9/05) Mr. Shellhouse stated that he intends to
conduct a survey of the street in the near future in anticipation of commencing
the reconstruction.
Abandonment of Property
(Lakeside Blvd.) – The Town
Council discussed a request to abandon a section of land located near 100 Lakeside
Blvd. (Minutes 7/16/07 et. seq.) As requested by the Council, the owner of
the property, Ray Dorman, obtained a survey and title search of the
property. He presented them to the
Council. Attorney Wright will review
the documents. Tabled until the Sept. 17, 2007 meeting.
Extension of Municipal Water Line –
Highway Superintendent Shellhouse reported that he received a request to extend municipal water service to a section of N.
Allegheny Ave. in West Ellicott. He
stated that he would determine the cost of extending the water line.
RESOLUTION #79-07
Payment of Claims
MOTION by Supervisor Tyler, seconded by Councilman Miller to pay 2007
current claims #866-902, inclusive, in the amount of $30,379.24 and charge
to the proper fund or account.

by Supervisor Tyler, seconded by Councilman Miller to adjourn at 7:16 PM.
