Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

October 18, 2004 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Geisler, Councilman Miller, Councilman Pickett, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker.

 

Supervisor Tyler opened the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called the roll. 

 

APPROVAL OF MINUTES

               

Motion by Councilman Miller, seconded by Councilman Geisler to accept the minutes of the October 4, 2004 meeting as presented by the Town Clerk.

CORRESPONDENCE

 

Town Clerk Erlandson read the following items into the record:

 

1.      Letter from Jeanne Sampson, 2865 Moon Rd. re a potential traffic safety problem at the intersection of N. Main St. Ext. & Moon Rd.

2.      Notice of thanks from Chautauqua Squares Dance Club for allowing them to utilize the Community Center at the Ellicott Administration Bldg.

3.      Invitation to an “Open House” at Fluvanna Free Library.

4.      Notice of an upcoming seminar re “Grant Seeking for Resource Development”.

5.      Notification of an upcoming satellite teleconference re “using accountability to build public trust”.

6.      Newsletter: Community Assistance Program.

7.      Newsletter: Chautauqua County Chamber of Commerce.

8.      Newsletter: Chautauqua Co. Fire Service.

 

TOWN OFFICERS’ REPORTS

 

Town Clerk Erlandson reminded the Council that a strategy meeting with Chautauqua Lake Partnership & URS officials would be held at 10:00 AM on Oct. 19, 2004 at the Ellicott Administration Bldg.

 

Highway Superintendent Shellhouse reported that he has developed a plan to upgrade the drainage facilities at the Burtis Bay Little League Field.  (Minutes 9/13/04 et. seq.).

 

Mr. Shellhouse also reported that Celoron American Legion officials have requested permission to utilize a “paper street” abutting their property located on Jackson Ave. in West Ellicott.  (Minutes 10/4/04)  He explained that the legion intends to install several horseshoe pits on the property.  Mr. Shellhouse recommended that the Legion be granted permission to utilize the property.  Attorney Lasker advised the Council to look into the possible insurance liability implications before granting permission to the legion.
 

OLD BUSINESS

 

Expansion of Water Service (Howard Ave./Baker St. Ext.) – Highway Superintendent Shellhouse reported that Engineer Rex Tolman is preparing a feasibility study re the expansion of municipal water service to a section of Howard Ave., Baker St. Ext. & Valerie Lane.  Mr. Shellhouse stated that Mr. Tolman would present three proposals at the Nov. 1, 2004 Town Council meeting.

 

Water Service on Orchard Rd. Tabled until the Nov. 1, 2004 meeting.

 

Tentative Budget (2005) - Supervisor Tyler scheduled meetings with department heads to discuss the Tentative Budget for Town of Ellicott fiscal year 2005. 

 

Motion by Supervisor Tyler, seconded by Councilman Miller to schedule a Public Hearing for November 1, 2004 at 7:00 PM regarding the proposed Town of Ellicott Preliminary Budget for fiscal year 2005.

NEW BUSINESS

 

Vacancy on Planning Board – Supervisor Tyler reported that Becky Holmstrom, Celoron, has resigned from the Town of Ellicott Planning Board.  Mr. Tyler pointed out that a Celoron resident should fill the vacancy.  He stated that Town Clerk Erlandson maintains a list of potential candidates who are interested in serving on the Planning Board.  Mr. Erlandson noted that one of the candidates also happens to reside in Celoron.  Mr. Erlandson was directed to contact the potential candidate re his interest in serving on the Planning Board.

 

RESOLUTION #118-04

Waive Variance Fee (Pauline Wood)

 

Motion by Councilman Geisler, seconded by Councilman Pickett to waive a $75.00 variance application fee for Pauline Wood, 2150 Swanson Road, Jamestown, New York.

RESOLUTION #119-04

Waive Building Permit Fee (PTO: Southwestern Elementary School)

 

Motion by Supervisor Tyler, seconded by Councilman Geisler to waive the building permit fee for the PTO of Southwestern Elementary School in conjunction with the placement of a new sign on the elementary school property.

RESOLUTION #120-04

 BAN Renewal (Ninth St. Bridge)

 

Motion by Supervisor Tyler, seconded by Councilman Miller authorizing the issuance of a Bond Anticipation Note in the amount of $25,600.00 for repair of the Ninth St. Bridge.  (see ‘BAN’ file for detail)

RESOLUTION #121-04

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Geisler to pay 2004 current claims #1151-1205 inclusive, in the amount of $173,580.99 and charge to the proper fund or account.
