Minutes of a Regular Meetin= g of the

Town Council of the Town of= Ellicott

held at = the Administration Building,

215 S. Work Street, Falconer, N.Y. on

October = 20, 2008 at 7:00 P.M.

 

Present: Supervisor Miller, Councilman Beckeri= nk, Councilman Lodestro, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Wright, Legislator Barmore.  Absent: Councilman Orlando.

 

Supervisor Miller open= ed the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called t= he roll. 

 

APPROVAL OF MINUTES

 

MOTION by Councilman Heintzelman, seconded by Councilman Lodestro to accept the minutes of the October 6, 2008 meeting as presented by the Town Clerk.=

PRIVILEGE OF THE FLOOR

 

Legi= slator Barmore commented on a proposal= to rescind the cap on the gasoline tax currently being imposed by Chautauqua Co.  (Minutes 10/6/08)  He stated that rescinding the cap = would generate an additional $44,000.00 in revenue for the Town of Ellicott.

CORRESPONDENCE

 

        &= nbsp;   Town Clerk Erlandson read the following items into the record:=

2.      Notice re an upcoming Public Hearing on the proposed budget for the= Fluvanna Fire District.=

TOWN OFFICERS’ REPORTS

=  

Counc= ilman Lodestro updated the Town Council on the numerous improvements that have been made to the Ellicott Administration Bldg. in the past few months.  He thanked the Ellicott Building Committee for its efforts in getting the improvements completed.

 

Counc= ilman Heintzelman reminded the Council that the Public Kickoff Meeting re the Town of Ellicott Comprehensive Plan currently underway will be conducted on Oct. 23, 2008 at 7:00 PM.&nbs= p; The meeting will be held at Southwestern Central Elementary School.

 

Councilman Beckerink reported that he will be attending a mee= ting on Oct. 23, 2008 re county-wide assessing.

 

Councilman Orlando reported that he has been meeting with the Ellicott Cemetery Committee.  He stated that the committee is looking into the possibility of purchasing flags for veterans’ gravesites in all the cemeteries within the Town of Ellicott.

 

Town Clerk Erlandson reported that he recently conducted a meeting concerning dog control issues.  The Ellicott Dog Cont= rol Officer as well as the DCOs for Celoron and Falconer also attended the meet= ing.  He stated that the committee will = meet again early next year to discuss the possibility of conducting a dog enumeration in the Town of Ell= icott in 2009.

 

Mr. Erlandson also reported that the municipal “co-operative” for purchasing electric and natural gas service = from Erie = County is in effect.  (Minutes 8/4/08)  He stated that the Town of Ellicott should s= oon begin receiving the services at reduced rates.

 

Supervisor Miller reported that an abandoned structure at 663 Fairmount Ave. was recently dem= olished.  He commended Town of Ellicott Code Enforcement Officer = Randy Woodbury for his efforts in gett= ing the structure removed.

 

Mr. Miller also reported that the Town of Ellicott officials would be working with Fis= cal Advisers on a municipal bonding matter concerning four (4) water distri= cts within the Town.

OLD BUSINESS

 

Partial Tax Exemption = for 1 & 2 Family Residences – Tabled until further notice.<= /span>

 

Preliminary Budget (2009) – Supervisor Miller stated that the proposed Town of Ellicott Budget for fiscal year 2009 is nearly complete.

 

Motion by Councilman Heintzelman, seconded by Councilman Becker= ink to schedule a Public Hearing for November 3, 2008 at 7:00 PM regarding the proposed budget for the Town of <= st1:City w:st=3D"on">Ellicott for fisc= al year 2009.

Code Change re “Light Industry&#= 8221; – Councilman Beckerink discussed his desire to amend the Town of Ellicott Code to allow “light industry” in certain “agricultural-residential” zones.  Specifically, he feels that the am= ended code should only pertain to properties with frontage along the portion of N= orth Main St. Ext. that is zoned “agricultural-residential”.  The Council discussed the matter a= nd recommended that the request be referred to the Town of Ellicott Planning Board for further rev= iew.

MOTIO= N by Councilman Beckerink, seconded by Councilman Lodestro to refer a request to amend the Town of Ellicott Cod= e to the Ellicott Planning Board for further review.

RESOL= UTION #86-08

Bond Anticipation Note (Sweeper)

 

MOTION by Councilman Lodestro, seconded by Councilman Heintzelman authoriz= ing the issuance of a Bond Anticipatio= n Note in the amount of $204,495.00 for the purchase of a Johnston Model VT650 Sweeper for the Town of Ellicott Highway Department.  (see 'BAN' file f= or detail)
