Minutes of a Regular Meetin= g of the

Town Council of the Town of= Ellicott

held at = the Administration Building,

215 S. Work Street, Falconer, N.Y. on

November= 17, 2008 at 7:00 P.M.

 

Present: Supervisor Miller, Councilman Beckeri= nk, Councilman Lodestro, Town Clerk Erlandson, Highway Superintendent Shellhous= e, Attorney Wright, Legislator Barmore.  <= /p>

 

Absent: Councilman Heintzelman, Councilman Orl= ando.

 

Supervisor Miller open= ed the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called t= he roll. 

 

APPROVAL OF MINUTES

 

MOTION by Councilman Lodestro, seconded by Councilman Beckerink to accept the minu= tes of the November 3, 2008 meeting as presented by the Town Clerk.<= /span>

PRIVI= LEGE OF THE FLOOR

 

Roger Loewenheim, 434 Orchard Rd. commented on a drainage problem involving the Verizon Wireless ce= llular phone tower located on the hill above Idlewood Dr.  In his opinion, the problem could be alleviated by constructing a new access r= oad to the tower behind the existing Me= dia One building.  This would eliminate the need for the current access road off = Idlewood Dr.

 

Legislator Barmore rep= orted that he is preparing a grant reques= t to obtain “bed tax” funding for cleaning up a portion of the Chadakoin River in Falconer.  (Minutes 7/7/08 = et. seq.)

TOWN OFFICERS’ REPORTS

=  

Counc= ilman Lodestro reported that the Ellicott Building Committee met last week.  He thanked the committee members f= or their efforts in successfully addressing many of the issues on its agenda in 2008.  He outlined a few of the projects that the committee will be addressing in 2009.

=  

Mr. L= odestro also reported that the Town of Ellicott received $24,000.00 from the New Yo= rk State Dept. of Transportation for the Lyndon Blvd. project.  (Minutes 1/21/08 et. seq.)

Mr. L= odestro also reported that negotiations with Town of Ellicott CSEA employees are underway.

           

Counc= ilman Beckerink reported that a report concerning county-wide assessing shoul= d be completed later this month.

 

Attorney Wright reported on a situation involving the cellular = telephone tower located on the hill south of Hunt Rd.  The tower is owned by Verizon Wireless.  He reminded the= Town Council that the tower can only be accessed by a private road off Idlewood Dr= .  He explained that the company rece= ntly applied for a renewal of their special use permit to operate the tower.  However, before granting the permi= t, the Ellicott Zoning Board of Appeals requested that the company address the recurring drainage problems associated with the construction of the tower.<= span style=3D'mso-spacerun:yes'>  Mr. Wright noted that, since the construction of the tower in 1991, several homeowners on Hunt Rd. & Idlewood Dr. have experienced periodic drainage problems.  In response to the residents’ concerns, the ZBA recommended that the matter be referred to the Ellicott Planning Board.  Mr. Wright st= ated that the Planning Board discussed the matter at its meeting on Nov. 12, 200= 8.  At the meeting, Verizon officials submitted an engineering study concerning the drainage problem.  Mr. Wright explained that the Planning Board has requested that the Town Council retain the services of Town of Ellico= tt engineer, Rex Tolman, to review the study.=   Mr. Tolman’s fee for reviewing Verizon’s engineering report would not exceed $5,200.00.  Mr. Wright noted that Verizon officials have offered to = pay a portion of Mr. Tolman’s fee.  He recommended that Verizon<= /i> be asked to pay half the fee (i.e. $2,600.00).  The Council discussed the matter.<= o:p>

 

RESOLUTION #92-08

Retain Engineer (Tolma= n)

MOTION by Councilman Lodestro, seconded by Councilman Beckerink authorizing the Town of Ellicott to retain the services of Engineer Rex Tolman to revie= w an engineering study prepared by Veriz= on Wireless regarding possible dra= inage problems associated with their cellular telephone tower located on Idlewood Dr.; and, further, that the fee for Mr. Tolman’s services not exceed $5,200.00.; and, further, that Veri= zon pay the initial $2,600.00 for the study and the Town of Ellicott pay the remaining balance, not to exceed $2,600.00.

Highway Superintendent Shellhouse reported that he, Councilman Beckerink & Councilman Lodestro met with representatives from Sherwin-Williams re the possibility of painting the water tower= at the Airport Industrial Park.  Initial estimat= es for painting the tower are $120,000.00 - $200,000.00.

 

Mr. Shellhouse also reported that he & Engineer Rex Tolman= are looking into the possibility of receiving grant funding for two road reconstruction projects in the Town of Ellicott.

 

Supervisor Miller reported that he participated in a conference call with Standard & Poor’s re the= Town of Ellicott’s bond rating.  (Minutes 10/20/0= 8 et. seq.)  He explained that the b= ond rating is necessary in order for the Town to proceed with a municipal bondi= ng matter concerning three (3) water districts within the Town.  He stated that the Town should rec= eive a favorable rating.  He also not= ed that the bond will close between Dec. 5 and Dec. 10, 2008.

Reimbursement for Water Meter (Schauers) – Town Clerk Erlandson reported that Cheryl Schauers, 1926 Camp St. Ext., recently connected to the municipal water line that runs along her road.  He explained that all homeowners w= ho connect to the municipal water line need to install a water meter.  He noted that the meters are insta= lled at no additional cost to the homeowner since they are included in the capit= al costs being charged to the entire water district.  However, Mrs. Schauers was mistake= nly billed $170.00 for her meter by the Jamestown= Board of Public Utilities.  She has asked to be reimbursed for the charge.

 

RESOLUTION #93-08

Reimbursement for Water Meter (Jose)

 

MOTI= ON by Supervisor Miller, seconded by Councilman Bec= kerink to reimburse Cheryl Schauers, 1926 Camp St. Ext. in the amount of $170.00 for the purchase of a water meter.
