Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
November 19,
2007 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Wright.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
MOTION
by Councilman Heintzelman, seconded by Councilman Miller to accept the minutes
of the November 5, 2007 meeting as presented by the Town Clerk.
RESOLUTION #97-07
Vacancy on Town Council
(Ward 4)
MOTION by Supervisor Tyler, seconded by Councilman Miller appointing
George A. Beckerink, 3930 Gerry-Levant Rd., to serve as Councilman for Town of
Ellicott Ward 4, filling the vacancy created by the resignation of
Robert Pickett; term to expire December 31, 2007.
Adopted. Ayes – 4 Noes - 0 Absent – 0
Town Clerk
Erlandson administered the Oath of Office to Councilman Beckerink.
Supervisor Tyler opened a Public
Hearing on proposed Local Law #1-2007 to increase the fee for filing a
rezoning request to $500.00. No
public comments were heard.
MOTION by Supervisor Tyler,
seconded by Councilman Miller to close the Public Hearing at 7:03 PM.
Town Clerk Erlandson read the
following items into the record:
1.
Resolution
adopted by the Chautauqua County Legislature increasing the Income Limits for
Partial Real Property Tax Exemptions for senior citizens.
2.
Notification
of Liquor License Renewal: Moonbrook Country Club, N. Main St. Ext.
3.
Invitation
to the annual Falconer Volunteer Firemen’s Association Christmas Party.
4.
Newsletter:
Chaut. Co. Chamber of Commerce.
TOWN OFFICERS’ REPORTS
Councilman Heintzelman reported that the Ellicott
Zoning Commission met on Nov. 15, 2007.
He stated that, during the meeting, representatives from three (3)
companies interested in conducting a comprehensive plan for the Town of
Ellicott made presentations. Following
the presentations, the zoning commission discussed the merits of each proposal
& made a decision on which company should conduct the study. He noted that the company selected also
happened to be the low bidder.
Highway Superintendent
Shellhouse
reported that a curb box has been installed on the water line in front of the
new Harley Davidson store currently under construction on Rte. 394 east
of Falconer. This will allow the
company to receive municipal water service.
Local Law #1-2007 (Increase
Fee for Rezoning Requests) – The Town Council discussed a proposed Local Law
to increase the fee for filing rezoning requests. The Local Law would raise the fee from
$50.00 to $500.00. Councilman Beckerink
asked for an explanation re why the fee should be increased. Councilman Heintzelman explained that $50.00
does not cover the costs incurred by the Town during its review of the
request. Attorney Wright also pointed
out that some of the rezoning requests are not commercial requests and have
little chance of being approved.
However, he explained that the Town Council is still required to review
every rezoning request it receives.
RESOLUTION #98-07
Adopt
Local Law #1-2007 (Increase Fee for Rezoning Requests)
Motion by Supervisor Tyler, seconded by Councilman Heintzelman to adopt
Town of Ellicott Local Law #1-2007 to increase the fee for filing a rezoning
request from fifty dollars ($50.00) to five hundred dollars ($500.00) to cover
the costs incurred by the Town associated with the request. (see

RESOLUTION #99-07
Shared
Municipal Services Grant w/ Chautauqua Co.
Motion by Supervisor Tyler, seconded by Councilman Geisler supporting the
efforts of the Chautauqua County Dept. of Public Facilities to obtain funding
for paint striping through the New York State Shared Municipal Services
Incentive (SMSI) Grant Program.
RESOLUTION #100-07
Resolution
of Support (Chautauqua Lake Management Commission)
Motion by Supervisor Tyler, seconded by Councilman Miller to support a grant
application being submitted by the Chautauqua Lake Management Commission
(CLMC) in conjunction with implementing a lake and watershed management
plan for Chautauqua Lake and its watershed. (see ‘Chautauqua Lake Management Commission’ file for detail)
RESOLUTION #101-07
Apply for SMSI Grant (Comprehensive Plan)
Motion by Councilman Heintzelman, seconded by Councilman Geisler authorizing
the Ellicott Zoning Commission to apply for grant funding of up to
$36,000.00 through the Shared Municipal Services Incentive Program; and,
further, that the funding be used to prepare a comprehensive plan for
the Town of Ellicott; and, further, that a local share of $4,000.00 be
allocated in the 2008 Town of Ellicott Budget, with additional local
amounts to be considered by the Villages of Celoron and Falconer. (see ‘Ellicott Zoning Commission’ file for

RESOLUTION #102-07
Payment of Claims
MOTION by Supervisor Tyler, seconded by Councilman Geisler to pay 2007
current claims #1186-1238, inclusive, in the amount of $56,753.10 and
charge to the proper fund or account.

by Councilman Miller, seconded by Councilman Geisler to adjourn at 7:18 PM.
