Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

December 3, 2007 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Beckerink, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Wright. 

 

Absent: Councilman Geisler.

 

Supervisor Tyler opened the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called the roll. 

 

APPROVAL OF MINUTES

 

MOTION by Councilman Heintzelman, seconded by Councilman Miller to accept the minutes of the November 19, 2007 meeting as presented by the Town Clerk.

CORRESPONDENCE

 

            Town Clerk Erlandson read the following items into the record:

                       

1.      Notification of Liquor License Renewal: The Apple Inn, 3373 Old Fluvanna Rd.

2.      Invitation to the annual Falconer Volunteer Firemen’s Association Christmas Party.

3.      Falconer Fire Chief’s Report: October 2007.

4.      Newsletter: Chaut. Co. Chamber of Commerce.

 

TOWN OFFICERS’ REPORTS

 

Councilman Heintzelman reported that the Ellicott Zoning Commission is applying for two (2) grants to obtain funding for a comprehensive plan for the Town of Ellicott.  He explained that both applications would be submitted by Dec. 14, 2007.

 

Councilman Beckerink reported that he and Town Clerk Erlandson recently met with the Plant Manager from Time-Warner Cable re the feasibility of extending television cable service to the Gerry-Levant Rd. and Ross Mills area.  Mr. Beckerink stated that the company will make a decision concerning the matter early in 2008.

 

Town Clerk Erlandson reported that he is looking into the possibility of the Town of Ellicott becoming part of a municipal “co-operative” for purchasing electric & gas service.  He explained that the group would purchase the services from Erie County.  He also explained that the Town would benefit by paying less for electric & gas service.  Mr. Erlandson noted that Attorney Wright has expressed concerns re several aspects of the proposed agreement between the Town and Erie County.  They will continue to pursue the matter.

 

Attorney Wright reported that the abandonment of property at 100 Lakeside Blvd. owned by Ray Dorman is moving forward.  (Minutes 7/16/07 et. seq.)

 

Highway Superintendent Shellhouse reported that he and Engineer Rex Tolman are finalizing the purchase of the skid for the new pump station in West Ellicott.

NEW BUSINESS

 

The Town Council scheduled the 2008 Town of Ellicott Organizational Meeting for January 1, 2008 at noon.

 

New NYS Requirements for Building Codes – Attorney Wright reported that the New York State Dept. of State is making changes to the NYS Building Code.  He stated that every municipality throughout the state is required to adopt the new code.  He pointed out that certain sections of the new code conflict with the Town of Ellicott Code.  However, he explained that the proposed new code is only a “model”.  Consequently, the Town has some flexibility regarding the specific language of the code.  He stated that he and Town of Ellicott Bldg. Inspector Randy Woodbury are going to review the proposed changes to ensure that they are compatible with the Town Code.  Mr. Wright noted that the new code should be adopted by the end of January 2008.  Prior to adopting the new code a Public Hearing must also be conducted.

 

MOTION by Supervisor Tyler, seconded by Councilman Miller to schedule a Public Hearing for Monday, January 21, 2008 at 7:00 PM regarding proposed changes to the New York State Building Code.

Expiration of Terms on Zoning Board of Appeals – Supervisor Tyler reported that the terms of two (2) members of the Ellicott Zoning Board of Appeals are expiring at the end of 2007.  The Council discussed whether to re-appoint the two members or appoint new people to the positions.  Town Clerk Erlandson was directed to contact the two members to determine if they wish to be re-appointed.

 

RESOLUTION #103-07

Payment of Claims

 

MOTION by Supervisor Tyler, seconded by Councilman Miller to pay 2007 current claims #1239-1295, inclusive, in the amount of $50,155.97 and charge to the proper fund or account.
