Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
December 6,
2004 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker.
Absent: Councilman Geisler.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Miller, seconded by Councilman Heintzelman to accept the minutes
of the November 15, 2004 meeting as presented by the Town Clerk.
Town Clerk Erlandson read the following items
into the record:
1.
Notification
of a satellite teleconference re “Town Boards & Town Clerks Working
Together”.
TOWN OFFICERS’ REPORTS
Councilman Miller reported that the Ellicott Insurance
Committee would be meeting at noon on December 10, 2004 to discuss the status
of the Town of Ellicott’s liability insurance policy with the Town’s insurance
representative.
Town Clerk Erlandson reported that bids for
modifications to the first and third floors of the Ellicott Administration
Bldg. would be opened on December 10, 2004 at 2:00 PM. He reminded the Council that the
modifications are being made in conjunction with the proposed relocation of the
DEC offices (Minutes 11/1/04).
Attorney Lasker reported that he attended a meeting of the
Ellicott Zoning Board of Appeals on Nov. 29, 2004. He explained that, at the meeting, the ZBA
denied permission for the Jamestown Rotary Club to install a “Welcome to
Jamestown” sign on property located on Route 60 in the Town of Ellicott. Mr. Lasker noted that if the Town Council
wishes to permit the sign it may authorize the Town of Ellicott to obtain an
easement for the property.
Mr. Lasker also recommended that the Council review the
Ellicott Sign Code. In his opinion, the
code is too restrictive.
Highway Superintendent Shellhouse reported on the
status of a possible traffic safety problem at the intersection of Moon Rd.
& Route 60 (Minutes 10/18/04). He
stated that the Chautauqua County Traffic Safety Board is looking into
the matter.
Expansion of Water Service
(Howard Ave./Baker St. Ext.) – Tabled until the Jan. 3, 2005 meeting.
Camp St. Ext. Water
Service/Orchard Rd. Water Service – Highway Superintendent Shellhouse reported that
the final costs for both the Camp St. Ext. Water Service Project
& the Orchard Rd. Water Service Project have been determined. He noted that the final costs for both
projects were less than anticipated.
Status of Employee Health
Insurance
- Councilman Pickett reported that Civil Service Employees Association
(CSEA) officials are evaluating several health care plans for Town of
Ellicott CSEA employees to replace the current plan, which dissolves on Dec.
31, 2004 (Minutes 9/13/04). Tabled
pending further review.
NEW BUSINESS
Waive Permit Fee (Peterson Signs) -
Supervisor Tyler reported that the owners of property located on Fairmount Ave.
recently withdrew plans to construct
a Starbuck’s on the site.
Because of the withdrawal, Mr. Tyler explained that Signs & Sales
By Peterson has requested a refund of
their application fee to the Ellicott Zoning Board of Appeals in
conjunction with the placement of a sign at the proposed Starbuck’s
site. However, since the request for a
refund was received, Mr. Tyler noted that plans to construct the Starbuck’s
are again moving forward. Tabled
pending status of the proposed project.
RESOLUTION #131-04
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Pickett to pay 2004 current claims #1356-1440
inclusive, in the amount of $63,432.75 and charge to the proper fund or
account.
Motion by Supervisor Tyler, seconded by Councilman Pickett to adjourn at 7:15
PM.
