Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
December 20,
2004 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Miller, seconded by Councilman Heintzelman to accept the minutes
of the December 6, 2004 meeting as presented by the Town Clerk.
Town Clerk Erlandson read the following items
into the record:
1.
Copy
of doctoral dissertation from Dr. Corinne Nyquist, State University of New
York New Paltz, re electronic transmission in state and local
government.
2.
Newsletter:
Chautauqua County Chamber of Commerce.
TOWN OFFICERS’ REPORTS
Councilman Miller reported that the Ellicott Insurance
Committee met with the Town of Ellicott’s insurance representative, Randy
Graham, on Dec. 10, 2004 to discuss the status of the Town’s liability
insurance. According to Councilman
Miller, Mr. Graham recommended that the liability coverage for the Ellicott
Police Dept. be competitively bid in 2005.
Mr. Miller also explained that the Town would be required to develop an
“employee handbook” as a stipulation for renewing its insurance policy. He noted that the Ellicott Police Dept.
already has such a handbook for police personnel & stated that it will be
used as a guide to develop a handbook for the remainder of the Town’s
employees.
Re-location of DEC Offices – Town Clerk Erlandson
reported that bids were opened on Dec. 10, 2004 for the modification of
the Ellicott Administration Bldg. He reminded the Council that the
modifications are being made to accommodate the proposed re-location of
the New York State Dept. of Environmental Conservation offices from the third
floor to the first floor (Minutes 11/1/04).
Mr. Erlandson reported that only one (1) bid in the amount of $90,300.00
was received. He added that the Ellicott
Building Committee discussed the bid and determined that the bid is too
high to accept. The Bldg. Committee
will explore other alternatives for making the alterations including the
possibility of performing some of the work “in-house”.
Status of Employee Health
Insurance
- Councilman Pickett reported that he and Councilman Geisler are still in
negotiations with Civil Service Employees Association (CSEA)
representatives re a replacement for the current health insurance plan, which dissolves
on Dec. 31, 2004 (Minutes 9/13/04). Mr.
Geisler recommended that Supervisor Tyler be directed to sign “broker of
record” letters. The letters would
authorize Integrated Benefit Solutions to act as the Town of Ellicott’s agent
re the administration of employee health care plans.

Sign Broker of Record
Letters (Integrated Benefit Solutions)
Motion by Councilman Geisler, seconded by Councilman Miller directing the Town
of Ellicott Supervisor to sign three (3) “broker of record” letters
authorizing Integrated Benefit Solutions to act as the exclusive Agent
of Record for the Town of Ellicott regarding the administration of
health insurance plans for Town of Ellicott employees and; further, that Integrated
Benefit Solutions provide their services at no cost to the Town of
Ellicott.
NEW BUSINESS
Agreement with SPCA –
Supervisor Tyler reported that the Town of Ellicott recently received a
proposed Animal Holding Agreement from the Chautauqua County Humane Society
(SPCA). Mr. Tyler expressed concern
that the proposed fees assessed to the Town of Ellicott in the new agreement
are significantly higher than the current fees. Town Clerk Erlandson estimates that the new agreement would increase Town expenditures approximately $3,000.00-$3,5000.00. Furthermore, he noted that the proposed
increase was not allocated in the Town’s 2005 budget. Mr. Tyler will contact the Executive
Director of the SPCA to discuss the matter.

Vacancy on ZBA –
Town Clerk Erlandson reported that Kevin Saff,
Swanson Rd, would be resigning
from the Ellicott Zoning Board of Appeals following the next ZBA meeting on
Jan. 10, 2005. The Council reviewed a list of potential candidates to fill the position. It was determined that the new member should
reside in the East Ellicott/Falconer area.
Mr. Erlandson will contact the potential candidates in those areas.
RESOLUTION #133-04
BAN (Renovation of Administration
Building)
Motion by Supervisor Tyler, seconded by Councilman Miller authorizing the
issuance and sale of a Bond Anticipation
Note in the amount of $298,800.00 for the renovation of the Ellicott Administration Building in Falconer, New
York. (see ‘BAN’ file for detail)

BAN (Lyndon Blvd. Reconstruction Project)
Motion by Supervisor Tyler, seconded by Councilman Miller authorizing the
issuance and sale of a one-year Bond
Anticipation Note in the amount of $343,000.00 for the Lyndon Blvd.
Reconstruction Project in anticipation of the Town of Ellicott being reimbursed
for the project from other funding sources (see ‘BAN’ & ‘Lyndon
Blvd. Reconstruction’ files for detail)
