MINUTES OF THE
REGULAR MEETING OF THE TOWN OF ELLICOTT PLANNING BOARD HELD AT THE
ADMINISTRATION BUILDING, 215 SOUTH WORK ST., FALCONER, NY ON MAY 12, 2004 AT
7:00 P.M.
PRESENT: Chairman Dan Evans,
Gary Swanson, David Carlberg, Becky Holmstrom, Phyllis Belin, Attorney William
Wright and Code Enforcement Officer Randy Woodbury.
ABSENT: Ronald Calanni and Michael Mogenhan.

Dan Evans called the meeting to order at 7:00 P.M.
Motion made by David
Carlberg, seconded by Phyllis Belin to approve the minutes of the April 21st, 2004 meeting.

for Kingsview Enterprises, Inc. appeared at the meeting re the
construction of an asphalt processing
plant on the corner of S. Dow St. & Allen St. Ext.
No representative
for Adams Lumber, Inc. appeared at the meeting re the removal of
timber on property located in West Ellicott east of Orchard Rd. The Highway Superintendent suggested that
the harvesting continue as of now. It
was recommended that the hours of operation be limited to 8:00 AM to 8:00 PM,
Monday through Saturday only, during the months of June and July. If the company requests a longer time
period, they would need to come back and see the Code Enforcement Officer.
Motion by Becky Holmstrom, seconded by David
Carlberg to waive provision of Site Plan Review in accordance with the above
stipulations.

Aversa/Patric of
West Oak Hill Rd., Jamestown, NY re request to build a pond. The Fluvanna Fire Department recommended
leaving the pond the way it is according to the plans. There is a problem with the depth and steep
bank.
Motion made by Gary
Swanson, seconded by Phyllis Belin to allow them to continue pending a receipt
of a full-scale copy of the plans.

Church of Christ,
875 Fairmount Ave. WE, Jamestown, NY presented plans for a 30’ x 60’
addition to the church to be used as a
fellowship hall, adding one unisex bathroom and improving existing bathrooms
making them handicapped accessible. It
will be a one-story brick addition and the brick will match the existing
structure. The parking lot remains the
same. The estimated cost of the project
is $180,000. The church was instructed
to bring in Site Plan to the June 9th meeting.
Information was requested
re 3425 Fluvanna Ave, Jamestown for prospective buyers. Before purchasing the property, the buyers
wish to know of any restrictions. They
would like to subdivide the property, possibly renting the existing house and
build a new one-story home.
The minimum square footage does allow
for a home to be built. The buyers
should check with South and Center Sewer District on sewer questions. The subdivision should not create any
problems with existing properties, as there are two compliant lots.
Fluvanna Community
Church, 3363 Fluvanna Ave, Jamestown, to create a new driveway onto
Bentley Ave. to give access to the rear of the property. The lot is 1-˝ acres and they intend to
lease the house on the lot. Eventually,
they hope to expand the church and will need a full Site Plan Review. The Planning Board will check with the
Highway Superintendent to confirm or not that Bentley Avenue can handle the
extra traffic.
George Means, with
property at 3200 Terminal Drive appeared to request a modified
Site Plan in regards to rental property at that address. The airport is requesting a formal Site Plan
Review. There is currently a problem
with cars from this business parking on the airport property. The airport does not want their property
used for this purpose. The area is
zoned Industrial and the current tenant is using the property for sales, storage and servicing of
vehicles. There is ample room on Mr.
Means’ property to add paving for additional parking. The “Grantee” on the lease is Kevin Smith. The Code Enforcement Officer spoke to Mr.
Smith and Mr. Smith stated that he would no longer be using 3544 W Oak Hill Rd
(zoned Ag-Res) for repair and maintenance of vehicles yet, on May 12, 2004, in
a phone conversation with Jay Shaffer, DBA as Auto Stores (per

Chautauqua County Clerk) Mr. Shaffer states that repairs are continuing to be done at the
3544 W Oak Hill address with two full
time mechanics. He states that no repairs are being done at the Terminal Drive
address. The Site Plan Review of May
2001, finished June 2001 was for a limo service. The Planning Board will review that Site Plan to determine
compliance.
A representative from the Falconer Rod & Gun Club, 2178 ˝ Buffalo St.
Ext., Jamestown presented a Site Plan Review to remove timber from a
section of their property as requested by the Planning Board at it’s April 2004
meeting. Watercourse issues will be
handled appropriately. There will be
1-2 trucks/day for 3-4 weeks. They
would like an 18-month window. The area
is zoned industrial and there are no plans to sell or develop the land. There should be no significant adverse
affects.

Swanson, seconded by Phyllis Belin to accept the Environmental Assessment. and
that there will be no significant adverse environmental impact.

approve the Site Plan.

Attorney Neil
Robinson, represented the Herman Kent American Legion, 777 Jackson Ave. WE,
Jamestown, in making changes to the Site Plan presented at last
months meeting. The plans are to: 1.
Reinstall horseshoe pits that were removed when addition was built in
1999. They will not be lit for
nighttime use. 2. Add picnic tables to be used by legion
members and their families. 3. Build a
pavilion, also to be used by members and families. The Legion would also like to plant grass
over a portion of the paper street known as Second Street. Ellicott’s Code does not state that this
has to be a public restaurant, thus the Code Enforcement Officer’s
interpretation is that it is a private restaurant that exists there by
right. There are other restaurants that
have similar facilities. The Legion is
instructed to file an application for Site Plan Review. The Code Enforcement Officer will make the
determination as to whether or not the plans are to be permitted.

If a determination that any of the plans is not
permitted, the Legion will need to go to the Zoning Board. If the determination is that everything is
permitted, then the Legion should do a Site Plan Review. The Town Board should handle the matter of
grassing over Second Street. The Legion
will need an agreement with the Town Board before coming before the Planning
Board on this matter.
