MINU= TES OF THE REGULAR MEETING OF THE TOWN OF ELLICOTT ZONING BOARD OF APPEALS HELD AT= THE ADMINISTRATION BUILDING, 215 SOUTH WORK STREET, FALCONER, NY 14733 ON MARCH= 29, 2010 AT 7:00 P.M.

 

PRES= ENT: Chairman Steve Hoglin, Alan Hendrickson, John Merchant, Angelo Cimo, Kathy    

Hedstrand, Phillip Pratt, Jean Holton, Attorney William Wright, Code Enforcement Officer Randy Woodbury an= d Secretary Valerie Pierce.

Chairman Hoglin opened the meeting at 7:00PM and Secretary Pierce ca= lled the roll.

 

Motion by Al Hendrickson, seconded by Phil Pratt to approve the minu= tes of the February 22, 2010 meeting

Chairman Hoglin swore in Tim Ruch (Good Time Saloon), 590 Fairmount = Av, Jamestown NY was sworn in. Requesting an expansion.  Mr. Ruch presented Profit= and Loss Statement, advertisements from two radio stations, Nightline and Penny Saver advertisements.  The nam= e will remain the same for the time being.  Mr. Ruch stated the interior has not been changed in 16 years.  Food sales have increased due to expanded menu.

 

If Mr. Ruch wishes to expand he would need the ZBA’s approval to obtain the Use Variance process. 

 

Motion by Al Hendrickson, seconded by Kathy Hedstrand to uphold the = Code Enforcement Officer’s decision that it is a prior non conforming use = and can’t be expanded.  He c= an apply for a Use Variance.

Public Hearing for Falconer Methodist Housing Development, 430 East Avenue, Falconer, NY.  Renewal of Spec= ial Use Permit for multiple apartments pursuant to section 146-9C.  David Brown, Lutheran Senior Housing Management Company representing United Methodist Gardens.  Would like to renew on 10 year basis.  Residential Zone, buil= t in early 1980’s.  Special U= se Permit has expired.  Fire insp= ection is in compliance.  Would like = them to make some improvements requiring Site Plan, possibly appearing before the ZBA.  An emergency generator is advised.  Sharon Hamilton, LSS manages property and has since 2002 and they are currently refinancing to g= et capital money to invest in the property.&n= bsp; Improvements to lighting and install generator, new roof, windows, n= ew supply shed, sided last year, blacktop enhanced street lighting and new carpeting.  35 Units for HUD.<= span style=3D'mso-spacerun:yes'>  For ages 62 and over.

 

Motion by Kathy Hedstrand seconded by Ang Cimo to approve renewal of= the Special Use Permit for Falconer United Methodist Housing Development Corp. = for 2 years to give them the opportunity to make proposed changes.  Exempt from SEQR.

 

Jean Holton abstained from voting as she is employed by LSS.
