MINUTES OF THE REGULAR MEETING OF THE TOWN OF ELLICOTT ZONING BOARD OF APPEALS HELD AT THE ADMINISTRATION BUILDING, 215 SOUTH WORK STREET, FALCONER, NY 14733 APRIL 26, 2004 AT 7:30 P.M.

 

PRESENT: Chairman Steve Hoglin, David Remington, Kevin Saff, John Merchant, Ang Cimo, Pat Martonis,  Rick Keefer, Attorney William Wright and Code Enforcement Officer Randy Woodbury

 

ABSENT:   

 

Chairman Hoglin called the meeting to order at 7:30 P.M.  Secretary Okerlund called the roll.

 

Motion made by Kevin Saff, seconded by John Merchant to approve the minutes of the March 29, 2004 meeting.

Chairman Hoglin reopened the public hearing for James Stanford and Michael Fiorella for a house trailer on S. Dow St.  Mr. Stanford had requested the matter remain tabled until May.

 

Chairman Hoglin opened the public hearing for the Evangel Christian Fellowship/Jeffrey Ekstrom, Routes 60 and 380.  No one attended the meeting regarding this matter.  Randy Woodbury spoke with the County Planning Board and they requested a sketch plan and an environmental study.  The sketch plan will also be presented to the Town Planning Board. 

 

Chairman Hoglin opened the public hearing for Bruce Battler, 15 Abbey Rd. WE for an addition to his 2-car garage.  His original proposal was 30’x32’.  He feels that he could do the project cutting back his plans to 28’x32’.  He would keep the same basic design matching the existing style.  He will have 2 doors in the front and one in the back.  The garage will be approximately 20’ from the neighbor’s driveway.  Richard Keefer spoke with six neighbors and they all approved of the addition.

 

Motion made by Kevin Saff, seconded by John Merchant to approve going from a three to four car garage.

Motion made by Angelo Cimo, seconded by Kevin Saff to approve enlarging the garage from 1,000 to 1,568 sq. feet.

Chairman Hoglin opened the public hearing for Angelo Cimo, 39 N. Hanford Ave. WE for a carport addition to his garage.  The carport will match the lines of the house and would be right on his neighbor’s property line.  No new survey would be needed.  Although Mr. Cimo’s neighbor has no problem with the carport, Mr. Cimo will talk to his neighbor about a Maintenance Easement.  The

Owner if the property with the easement has the right to request compensation for the easement.  Mr. Tom Stuart, another neighbor stated he has no problem with the carport as he felt that it would increase Mr. Cimo’s property value thus increasing the values of near by properties.

 

Motion made by Pat Martonis, seconded by John Merchant to approve an area variance, contingent upon receiving a Maintenance Easement (recorded with the Chautauqua County Clerk) prior to obtaining the Building Permit and to approve a second attached garage.
